If that's the issue, then there's either a problem with minimum wage or there's a problem with the restaurant industry itself. If the restaurant isn't paying more than minimum wages to the restaurant servers, then that's an issue of the industry being either overly competitive or the industry...

This depends on the state. Not every state allows for pay under the minimum wage. States like CA where it's mandatory to pay minimum wage, then any tip earned is a windfall for the server.

I would be willing to bet that the (B) criteria is not actually subjective but based on a mix of subjective and the objective reasonable person standard. Rarely will the law allow a purely subjective law as it creates enforcement issues.
