Why is it even a question that Bush's domestic spying is illegal?

Since the communications were with foreign parties the border search exception to the fourth amendment applies. You don't get 4th amendment protections when you cross into the U.S. and neither do your communications. The argument is that Bush broke FISA, you don't really have an argument...
