Okay I will be getting in touch with my CC company and will have a talk with the gym manager this week. I've filed a complaint with the BBB as well.

Thanks for the help guys- hopefully I won't have to resort to any of the more drastic measures mentioned but if all else fails I'll definitely make things as difficult as possible for them.

This lol. But yeah, I've dealt with Ballys as well (used to have a membership in the past) and granted, I never got scammed into a contract (we got a pretty good deal at the time. I think it was $360 for 2 memberships for 2 years) they were extremely pushy and did try to get us to sign w/o reading the paperwork.

What state was this in. If it was in NY, you have 3 business days to cancel the contract.
I agree you should always make an attempt to read the contract. But it sucks that Ballys would try to be so fraudulent. Do not do anything more that puts yourself at legal risk. Be calm and patient, and act better than they did. (The false information you supplied could actually put you into lagel problems, that was fraud.) Hope you have luck getting out of it.

I find it amazing that they are still in business. Ballys? Are they related to the pinball machine manufacturers?? Are they underworld or something? How can they survive with their reputation? I've heard of their scams before, years ago. These aren't the best economic times and I'd think that a crap company would be out of business by now, long ago really. People want good vibes when they go to a gym, not slight of hand. In a gym (it goes way beyond the gym, of course) you want folks to be up front, be completely straight with you. I'd avoid a gym with business practices like these like the plague.

I agree he was likely mislead by the salesperson, however how the HELL do you sign your name, SSN (regardless of whether he used a fake number), address, credit card #, etc without knowing what the heck you are doing? At that point your little spidey sense should kick in and tell you that a "free trial" would not require all that information. Seriously, that is blatantly ignorant.

Went well, overall quiet for a Monday but it's most likely because so many are out for vacation.

Bally Total Fitness does send info to collection agencies and they make it on credit reports
Mine is on my credit report (it just says I joined) and I didn't even give them a proper SS#. It just says every year they charge me a set amount to my CC.

Which is like $105/year.

Never, under any circumstances, offer a credit card unless you intend to make a deal. The law looks at it as consideration. Even if the sales man was sleazy, good luck going up to a judge. The judge or lawyer will both say the same thing I did. NEVER GIVE YOUR CREDIT CARD OR ANY OTHER FORM OF CONSIDERATION.
