February 2, 2005 -- The sniveling jailbird charged with shooting Nicole duFresne had an "accident" in his trousers when a cop pointed a gun at him during a 2001 arrest, documents reveal.
Rudy Fleming admitted pointing a gun at Staten Island cops in 2001 when he was stopped for truancy ? but lost control of himself when a cop aimed a gun back at him, according to a transcript of his parole hearing last year.

"Everything went crazy, and the police officer pointed a weapon at me, and I got nervous," he told the three-member parole panel. "I had a little accident in my pants, to be exact."

Fleming was hauled in for truancy and was being searched by a school safety agent when she asked him whether he had anything he shouldn't, authorities said.

When she noticed the gun, she hollered, which brought four cops running over, guns drawn ? and Fleming pointed his .380 semiautomatic pistol at them.

"At that moment, I knew I was doing wrong, and I was trying to give the weapon, but the woman beside me panicked, and everything went crazy," Fleming told the board.

He also said he learned from his time in the joint because prison "teaches you to learn from your mistakes."

Absolutely not. Living in fear is not the answer. I mind my own business, treat everyone with the respect I expect from them, and maintain 360 deg situational awareness at all times. In cases like this story, I shoot first, and since I live in Arizona, I am legally protected by ARS 13-411 to do so thank you very much (ie: use of deadly force to prevent armed robbery is lawful).

I think you may have misunderstood me... I was of course referring to the socialist pacifist nature of NY.

wtf? gun control laws would have done nothing to save her child, NYC has one of the strictest gun control laws on the books, and it doesn't do any good. Im sure this kid didn't get his gun by any legal means which throws all the laws out the window...friggin people...

The only reason her death has gotten so much attention is because she's A WHITE FEMALE! If it had happened to a black couple the story would have been talked about for a day and then it would have been quickly discarded.

And you guys know that.

Some still will...especially the ones so desperate or strung out they can no longer be rational. But you're right that it will decrease in frequency, as proven over the last several decades worldwide. Of course, it's not just the fear that would reduce it, a lot of them would be shot and killed...fewer criminals = fewer crimes.

I doubt it's legal, but "window of opportunity" would be there as they must retreat vulnerable unless they kill the whole group...

I think I would have if he shot my wife like that. my life would be over so what's the diff.

That's hard to answer, because of the way it all went down. I would have handled the whole thing differently. However, I'd like to think with all my experience and training I'd be able to avoid such a choice, either by avoiding the whole situation, giving them something so they'd go away without hurting anyone, or managing some method to kill them before they killed any of us.

IF I was in a similar situation where someone I was with was shot, then yes, I'd kill them no matter what (if I was able to). Law means very little to me, justice is FAR more important. The only real question is rather I'd go for the cover-up/excuse out, or just stand up and take my lumps in court. I'd like to think I'd stand up and take it, but it's hard to say without being in the situation. I mean, you could always take aim from cover, whistle at them, shoot them when they turn and then claim later that they were turning to fire again. In court you could claim temporary insanity. Etc.

This is America. If you don't assume that EVERYONE has a gun you've probably made a serious error in judgement. One that could cost you your life (and did in her case).

An armed society is a polite society, for just that reason.

Besides cases like this is what the "insanity defense" should be for anyway...not some freak with bodies in his refigerator.

I would be "temporarly" crazy as bat sh1t if I saw someone cold blooded murdered in front of me.
