I thought I posted in this thread before, but anyways:

1. If the restaurant states upfront that there is an additional 18% charge on top of the cost of what you order, then agree to pay it or leave. Just pretend the costs on the menu are 18% higher.

2. Otherwise, I don't see the need for tips. Servers should at least be paid minimum wage. If they don't make enough in tips, the restaurant should pay them more until minimum wage is reached.

3. The server takes my order, brings the food and drinks (with a pitcher please, I can refill my drink myself) to the table, occasionally picks up what few dirty plates are on the end of the table, and brings the bill. That is all I ask, and I don't see how that service warrants extra money. When I go to Carls Jr. they take my order, bill me, bring my food to the table, and even sometimes pick up dirty or unused trays. I don't tip them. Servers cosntantly bugging me and pretending to be so nice to try to get a good tip are annoying.

There is a reason we have a tip system in place....there is also are reason they are not paid min. wage...let's just get rid of commissioned people too.

Carls Jr...you fucking serious?!? Pretending to be nice? Why leave your house?

Then why would you want that, as a customer? The staff would have a reduced incentive to offer good service.

It's fucking carrying plates of food JFC. Complain to the owner and have the server fired if they don't perform with "good service."

She probably didn't tip her first couple of times. Then they made her tip 18%. Then they ban her because she's cheap.

I see nothing wrong with that. They can refuse to serve her. That's the owner's choice.

this is also a case where "any publicity is good publicity" doesnt really apply. if you have 200 customers a day and one tips poorly, go through a news story like this that affects 30% (random amount, could very likely be closer to 2-5% or anywhere in between) of your business due to it, that one bad tipper cost you a bunch more than just one sale a month.

Ok. For all the tards that did not read the article.

1. The woman walks in the place
2. BEFORE SHE EVEN GETS SERVED, the restaurant tells her that she is required to tip 18% to be served there
3. At this point, the lady can either enter into the contract stated above, or she can walk out of the restaurant.
4. If she does not agree to the contract stated above (18% gratuity added to the meal), then the restaurant has every right to refuse her service.

This lady has been going to the restaurant for over a year. She has been leaving crappy tips for over a year. Now the restaurant is getting sick of it. They require her to enter into a stated contract before they will serve her. The restaurant has every right in the world to refuse service.

Just like you have a right to go in there and slight the restaurant time after time, the restaurant has the right to tell you the fuck off unless you tip a decent amount.

did you not read the part where on the menu it says mandatory tip for 6+ people and the joint charged her that tip when there was only 2 in her party?

It's taking orders for a group of tables simultaneously, while also making sure their drinks are filled, checking in on them regularly, delivering the order at exactly the right time, and several other things. It's not just carrying a plate of food at most sit-down restaurants. Perhaps you should try working in the food service industry a bit... might help you understand.

Also... you would rather complain to the owner and hope they do something than actually not pay as much money? Really? Do you walk around with a hard-on for a fight fight too or something? Why would that be preferable to actually paying less money and making the message pretty clear without even having to leave your table?

meh. this is a bs story. IF the restaurant does not want her going because she is a bad tipper then that is there business.

if she wants to eat there then maybe she shouldn't be a cheapskate. This is not a race issue at all.

I hope this restaurant is driven out of business.

this is where people like yourself are telling us the level of your social status.

You'd be better off sticking to burger joints if that's your thoughts on eating out and service.

Then again I think most here are still living with parents or 'roomies' and haven't really grown up yet.

The reason they do that is because they never know when they are gonna get stiffed, and it hurts much more from a larger party with a big bill. They figure they can take the risk with smaller parties. In this case, though, they know from past experience that she's gonna stiff them, so I see no problem with changing the rules for her.

huh? according to the story she got charged a mandatory tip for a group when it was just her and her friend. she paid it but that is bullshit. i know i would not have paid it.

This has absolutely nothing to do with the "mandatory tip for a group". There was a mandatory tip for her and her alone.

She is known as a shitty tipper, so before she even gets served they tell her she will be charged an 18% tip. There is nothing wrong with this.

Monica Covington said her spat with the restaurant began in 2008.

"I noticed on our ticket that they added 18 percent gratuity and there was only two others with me at the time," Covington said.

The restaurant menu clearly states that a 15 percent gratuity will be added to parties of six or more. Covington said she complained, but paid anyway.

When she returned to the restaurant a month later, Covington said she was informed that she would have to pay an 18 percent gratuity if she wanted to dine there.

"Before we could even get seated, we got into the door and they came to me and said, 'If you aren't willing to pay the 18 percent gratuity, then we can't serve you,'" she said.

Went to Applebees last weekend. We ordered an appetizer while we were looking at the menu. Waitress took our order when we were ready. Someone else brought our appetizer - cheesesticks. No napkins, but there were two of those little napkin like things - about 4" square. Son & girlfriend tore theirs in half & shared it. Eventually, 2 other people brought out our food. Where's our waitress?? We sat & stared at our food for a moment, looking around for our waitress. My wife finally went up to the person that seats you and asked for silverware. We got one set. That person realized "hey, no one at this table has any silverware" and left to get more silverware. Finally got that. I think that later on, our waitress was tipped off that I didn't look to thrilled - she must have stopped by our table 10 times in as many minutes to ask "how is everything?"

Food was meh - too salty (hey cooks, I may not have silverware, but I've got a salt shaker on the table. How about a minimum level of salt and let me add salt if I wish.) My vegetables were the only thing that I enjoyed. I had french fries with my meal - I would have used ketchup to help drown out the saltiness a little bit, and I did succeed on about 3 french fries, but otherwise the ketchup bottle on our table was empty.

But, I still gave her 15% - didn't order desserts. I hope she has to split the tip with the people who brought us our food & silverware. If not, sadly on our table alone, she made well over minimum wage - and that's about all she deserved.

No one, period, has to tip if they don't want. But I am quietly confident if that lady was White, they'd never try to pull that spit.

On the same token, if the lady was white she would be less likely to leave a shitty tip. Black people are the worst tippers.

That's bullshit. Where do they get off actually requiring a tip? A tip is a nod for good service. A mandatory tip is a price hike. They should just raise their prices.

Wrong. Verbal contracts are just as "contractual" as signed ones. The only difference is you can't exactly prove you made a verbal contract unless you have it recorded or have some very good witnesses.

It seems this story has 3 stages.

1. Lady comes in several times over a long period of time and does not tip.
2. Lady comes in as per usual and gets an 18% gratuity charge added on her bill after the fact, without being told before.
3. Lady gets mandatory 18% gratuity notification before sitting down.

The lady is being a bit of a dick in stage 1. The restaurant was plain wrong in stage 2, but the lady paid anyways so there's not much she can do about it now. There's nothing wrong with stage 3 either. The restaurant can charge her whatever they want and she's free to refuse or accept. She's also free to tell the world about it if she likes.
