BMG Music Service Class Action Settlement

IV. THE PROPOSED SETTLEMENT
The terms of the proposed Settlement are as follows:
A. Class Benefit
As set forth in the Settlement Agreement, Defendant shall mail to each Class Member who is an active member of a BMG music club a Voucher. Class Members who are no longer members of a BMG music club must complete and submit by mail to BMG a Claim Form, which will be available at www.bmgmusic.com/stelk/settlement, and provided to any Class Member in response to an oral or written request. Those who, as of the date of entry of the Order of Preliminary Approval of Class Action Settlement, have not yet fulfilled their contractual commitment by purchasing the requisite number of CDs will receive a Voucher for 75% off BMG's regular club price for one CD, free of shipping and handling charges. Those who, on or before the date of entry of the Order of Preliminary Approval of Class Action Settlement, have fulfilled their contractual commitment by purchasing the requisite number of CDs will receive a Voucher for two single CDs for 75% off each of said purchases, each free of shipping and handling charges. Said Vouchers shall be valid for one year from the Effective Date of the Settlement.

Do you know you can cancel, re-join to have the so called "12 for price of 1" promotion? I did it for a couple of time within 4 years, not intentional abuse the system, I did not have much to buy, a year later I want to buy some junk....

Another thing you can do with 2 addresses is sign up, get your cd's, then sign yourself/spouse/gf up via the first address for the second address to get a bunch more free cd's

If I am not mistaken, most CDs at BMG are $16.98. So, you will get your 1 or 2 CDs for $16.98 x 25% = $4.25 each.

BMG runs YourMusic.com and offers $5.99 CDs shipped in any quantity any time. Some people were actually able to get on a $4.99 deal (Old Thread).

So, BMG will make out like a bandit on this "fair, reasonable, and adequate" settlement. I am sure they will not loose money on $4.25 CDs. They will get a lot of orders from people not aware of YourMusic.com who would not have bought anything otherwise. BMG will boost their mailing list in the process as well, and will send out some crappy credit card and decorative plates ads as well and make money from the advertisers.

Obviously, for a consumer there is little reason to get excited about this "deal" as filling out the Claims form is not worth the $1.74 saved (if that much).

I think there's a class action suit with BMG every year.
