Can you ban smoking outdoors?

It's illegal to smoke inside, it's illegal to smoke within a certain distance but now a town in Colorado is trying to ban smoking all together.

Would this ever fly in America?

Sure you could ban it. You can pass a law for any stupid little thing you have a bug up your ass for if you can get enough people to go along with you.

Enforcing it would be another matter. I doubt you could effectively enforce a stupid law like this.

I know there are plenty of HOAs that ban smoking outside of people's own homes and its been found to be perfectly legal when they do it so i dont see what prevents and entire town from enacting that same sort of law.

Here in Canada (NL province), there is a ban on outdoor smoking around main entrances of public buildings such as hospitals but not for every public building. It was put in place shortly after smoking in public buildings was banned and large crowds of smokers where gathering around the main entrances, which is bad for some places like hospitals.

I hate smoking but I think banning it outside is a bit ridiculous. As long as the butts are disposed of in a tidy fashion, I don't see a problem.
