You cannot get busted for downloading. Thats violates your privacy rights. They cant know what u download.
However, they can upload from u and if they get a "full" file from ur particular ip, u can be. If that file is illegal, u are violating the copyrights, and could possibly be charged.

I know you're doing this in good faith, but just let me clarify some points that you made.
It is not illegal for them to "bust" a person for downloading. If they setup some sort of server, and you leeched files off of that server (via FTP, newsgroups, BT, whatever), they may log the information, and one day find a way to legally go after you.
They do not need to get the "full" file to charge you with copyright infringement. As long as they know the tracker contains valid information and you're uploading files that coincide with the tracker, they can prosecute you (this applies to BT). If they download a file from you running any type of server, and it does in fact contain copyrighted material, they can prosecute you.
There really isn't any such thing as an "illegal" file. By "illegal" you mean copyrighted.
