Car Accident & Compensation

Ok, well i got into a small accident with a girl who was uninjured and the scratch was only minor. We mutually decided not to go to our insurance companies because it would be a hassle.

The girl's mother wants compensation for missing a day of work for her daughter (who took some asprin and decided not to wake up) oh yeah, the 2 other passengers in that car went to school the next day and weren't injured at all.. (5mph hit from behind..) Well overall they want about $600 dollars (310 to fix the car and 136 for 1 day of work) and some other expenses that i'm not too sure about.

Does anyone have any idea of what the laws of compensation in the US and or Washington state?

Bluff. Tell her that you will willingly pay for the auto damage, but since the 2 passengers showed no sign of injury, you would be happy to let the insurance companies work out wether she should be reimbursed for her day off. When she hears the offer to take it to the insurance company, she'll probably back down cause she won't want her rates to go up.

BTW, 310+136=446, what else do they want that's worth $150?

Actually, this happened to me, i was in an accident, and was the only person hurt (whiplash) out of 3, i settled out of court for a barely 5 digit amount, to cover pain and suffering. It is a valid point when a minor is involved. If you get sued, and have to get a lawyer it will be cheaper to settle.

If you get sued, you better get your insurance company to go to bat for you...that's what their there for.

I got hit from behind, it totalled my car...the car was worth maybe $6K if it hadn't been in a wreck (prior to this one), but since I had done $4K worth of damage to it (before the wreck) it probably was only worth around 4K. I got $8500 for it, since I disclaimed all medical costs - all I had was a lil sore whiplash.

i work as a insurance claim adj..and to let u know ins would pay her damages..poss rental expense..and that is it..310 for damage maybe 2 days or rental car for 25-30 per day..ins would not pay for a person not in the veh for missing 1 days worth of work..if the people are unreasonable an ins company might pay $100 for pain and suffering for the driver and make her parent sign a release.
but nothing more than that especially if she never went to the doctors.

if there is any doubt in your mind report it to your ins comp
also different states have different thresholds for the amount of damage paid before it affects your premiums..CA is 500..i believe NV is 300.you can ask your ins comp and they should be able to tell u.

If the other party decides to report the accident to their company and you did not, you might get the shaft bigtime! Every policy I've ever had says EVERY accident MUST be reported or you face cancellation. If your company chooses to cancel, you are at the other parties mercy.

yah check your state laws. in georgia you must report damages over $250 or if an injury occurs to the police. Violating the law easily opens up a can of worms.

Rule of thumb. ALWAYS report all accidents to your insurance company. Especially if theres any inkling to your fault. If they sue you because and your insurance company says "tuff you didn't report it withing ...." You could be faced with liabilities..

There are many loopholes insurance companies can use to evade paying your claim.

well according to WA state law i only have to report if there is $700 dollars or more worth of damage. But i'll be callin' my INS company later. Thx all
