Per experience, CC always ask for your name or telephone no to see if you are a previous customer...problem is, if the guy used a fake name and bought it with cash then it would not be traceable.

That's the problem with these kinds of things, whether you are scamming or not the same pattern is fallen into.

Actually it'll be the previous customer's word vs Circuit city's. CC should have checked the item before reselling it. It's as simple as that.

Things have way less value once opened....even new, opened box Cisco drops 20-50% (sometimes thousands)....regardless of return method CC should have the previous purchasers info....if it checks out then it's a pissing match. The thing is your return history esp. the other vid card is highly supicious (I am not saying you are a crook though)....the only time in several years I have been selling items that the same person had two identical/similar problems with the same product I later found the serials were doctored. I am also a customer and when I was younger I social enginneered a ton of things (not returning items or stealing really) by acting as if I was caught up in something wrong and in general playing dumb to the system.

Hopefully they have the previous purchasers info and it proves invalid, that would be a good indication something was wrong with the return originally or he was scamming.

It's hard to trace b/c of the high turn over rate in retail. Also, I don't think CC is capable of doing the trace. Unless there is other ways, it's hard to trace. All we know that the Radeon 9800PRO only been out around 6 months or so. Hopefully they can trace it, otherwise I would have to pay this great sum so near to the holidays.
Also my Hurricanes lost today. Nothing goes right for the past 2 weeks.

You do realize that if people have shrink wrap machines, so do the stores. Besides, all you practically need is a hair dryer.

I would file a police report, if you can get a friendly police officer, perhaps offer a coffee and doughnut ;-) to go into the store with you to get information. The other day my wife was accused of stealing a pair socks at a store, no kidding socks (sucks to be black in America). The manager was all hot but his attitude changed when the police officer approached and we walked up to him and said "I am glad to see you." All of a sudden his attitude changed as did his story. Having the Police on your side can change things, as CC perpetrated theft on you by not being diligent to make sure the product was in the box after the return. Besides selling a return with out an "open box" ticket is not very honest any way.

Damn if someone accused my wife of stealing crap which she didn't, I'm afraid I'd have to beat them. Or at least make sure they get fired

Why is that? They are just doing their jobs, I have been accused of stealing and got a little p!ssed about it in the past, but now that my wife is in retail I understand, they lose a lot in theft...there is always 3-5 'sensors' on the floors of the fitting rooms and this is an upscale mall with rich kids doing the stealing.

Fortunately every person she has accused has also had clothing they did not pay for in their bag.

I wish I could find a police officer when I need one. But my problem is not an urgent matter and I doubt that the police will come just for this, as CA is short handed with law enforcement.
I have filed the dispute with the credit card and they have removed the charge pending investigation. The district manager was suppose to call me but not yet. I have called to remind corporate about it. But nothing yet. I think I will wait to see what the credit card company, Capital One, will finally decides. I don't know how are they going to investigate this matter? Does anyone got any ideas?. If the credit card goes in my favor, then I will do nothing else. If not, I will take one step further to corporate. Then to the consumer's affairs. I have filed a complaint with the BBB already.
Anyone can think of anything else? I talked to an attorney and he said the police report is not warrant as no actual crime has occurred at the time of the purchase.
