My take on copyrights and patents would be the reduction route. I'm all for an entity, individual or corporation, being able to own a patent. You design something novel, you should have the right to the profits from that patent. Patent squatters should be addressed, if you hold a patent for something and do nothing with it for a length of time without showing any progress, such as production, then that patent should be invalidated and opened to everyone to build and compete with. Filing generic patents should also be addressed. Numerous patents filed by Apple, for example, so generic that they've basically been used by other companies for years. They've also applied for patents on numerous technologies that have been in use for decades and that were designed by other groups, CPU undervolting and displaying graphical icons on a grid, to name too.

Software patents get very sticky, but in general, I think they're over done/used. After a period of time, all software and code should be open sourced as well.

Any large corporation which wanted to use your invention without saying will do so and I highly doubt you could afford a protracted legal battle over it. At the very least, I'm sure your invention is likely similar enough to another patent that if a patent troll ever stumbled across it would make your life hell if they thought they could make a buck.

If you're so damned knowledgeable about patents and electronic theory and designs, try looking up my patents, reading them and giving us a full report on exactly how and why my inventions are "similar enough to another patent." If you can't, just because you know absolutely nothing about anything doesn't mean you repeatedly have to prove it to everyone.

Patents benefit inventors, some of them work for a company, in that case the company has the patent rights, in other cases patents benefit original creators, in any case, it drives competition, which is key in the free market and something you should love.

My point was that all it would take is for a patent troll with a somewhat similar patent in their portfolio of thousands of patents to decide they want to take you down and there's likely nothing you can do about it unless you have a warchest of money set aside for multi-year patent battles.

Patent reform, particularly in the software arena is absolutely necessary. I generally agree, however, that patents are an important part of innovation. I see that every day where I work. We hold multiple patents on inventions of ours, which fuels our innovation.

Truthfully, most patent violators are just lazy. They don't bother to check what else is out there and just do something a certain way. Often, there are other ways to accomplish the same thing.

Also any chance you could summarize the video for us that are at work or can't watch?

If the patent violator "reinvented" something that was already invented in software code, it seems that perhaps the issue is that the particular style of coding was obvious & not a novel thought. i.e. in software, they're allowing patents on what is akin to allowing people to patent the idea of filling in a hole in the ground with dirt.
"Ahhh, but we got the patent first! You'll have to patent some other idea, like filling it in with gravel."
The net result is bloated & inefficient coding.

3) Too many patents are issued for obvious changes. To keep the post small, the Prilosec/Nexium would be a good example to consider here. If both forms of the drug are the same, then it is obvious that just one would perform well.

I'm not sure if it's true in this particular case, but a lot of times in organic chemistry & medicine, one isomer is reactive & has a desired effect, while the other isomer doesn't do squat. That is, sometimes a left mirror image forms a key that fits into some particular protein (for instance), but the right mirror image doesn't. Some chemical processes to create a certain compound may not favor just one isomer, but may result in a cis and a trans isomer in some proportion. Perhaps in the particular case you cited, they figured out a way to produce just the desired isomer, allowing them to decrease the necessary dosage to be effective.

They're not guaranteed by the Constitution. It just says that Congress can choose to do it. There was a gap of several years after the adoption of the Constitution and the adoption of patents.
