On 11/21, the day before Thanksgiving, I went to three DSG stores looking for a Troy Carbine.

The first and second stores offered to pre-order the rifle for me, each giving me a different lead time (one said 1 week, the other said 2-3 weeks). I said "no thanks" to both offers. I hate pre-orders for ANY type of product, because it has always been my experience that you can find what you're looking in-stock for with a minimal amount of searching.

And in my case, the searching was extremely minimal, because the third store I went to had two rifles in stock and had no problem selling me one two days early.

But if you hadn't pre-ordered, there were many other great deals to be had. At late as 10 days ago, you could have purchased any AR15 you wanted and probably found a great deal on it. Then Sandy Hook happened on the 14th, and the buying frenzy finally burst the dam on the 17th. Anything that might possibly be affected by a ban, from ARs to 11+ round magazines of all kinds to ammunition were wiped out.

Your whole "they have to fill my order or else" seems odd. I'm not a lawyer, but I would imagine that if the company doesn't stock the item anymore and refunds your money, your case doesn't have a leg to stand on.

Imagine if this happened on a bunch of stocks instead? I agreed to and paid for a bunch of stocks at a set price. Only to have the company come back a month later and say, nope, here's your original money back. By the way, if you want the same stocks, they are 10x's that original price you thought you paid a month ago.

Same premise, same concept, just a different item. Instead of a firearm, it could have been anything. The point I'm making is if people let this happen, it will continue to do so. If no one does the right thing, eventually companies will lobby to get the laws changes since no consumers care if they get screwed over.

As for being a gun nut, I'm far from it. In fact, this was my first gun purchase ever.

But it didn't happen to a bunch of stocks.

Stop dwelling. Shut up. Move on.

LOL, seriously. Refund and $100 back? Go buy the damn thing somewhere else. I'm sure that Dick's isn't the only place that sells the AR15.

Again, I'm doing my part as a responsible consumer. I've alerted others to the illegal practices of a company in a public manner. I also intend to hurt them where it counts as that is the only way to make companies like this realize that illegal business practices should not be tolerated no matter what type of illegality it is. I stand to make a pretty penny off these imbeciles for this and while it will take a bit of work to do so it is worth the effort.

You already got a refund plus some. You stand to lose a shit ton in court costs if you try to go above small claims. I would laugh my ass off if you tried going beyond that.

OK..I have to admit. That post made me laugh.

While I do like dicks, I do not shop at Dick's. I am not employed by Dick's or in any way affiliated with their company. I think they are overpriced and their employees are a bunch of snot nosed morons who have no idea what they are talking about.

So I do not shop there. I don't give them my money, that's the things work. Posting on the internet and sounding like an even bigger whiny bitch than their employees does your cause no good.

And I'm posting in a public place because that is what adults and responsible consumers do. When I have a good experience beyond the normal I post that experience as well. Soemthing which most responsible people do. I write reviews on Amazon for products or movies at IMDB. Why? Because I like having that information when I decide to make future expenditures and I appreciate people that take the time to inform others. Since I do appreciate others that take that time I also make time to do the same. You seem to fail in understanding this basic concept.

By contract law, they are bound to fulfill the order. So if I'm am forced to go elsewhere to buy the item, they are required to pay the difference in cost, time, and a bit of punitive damages.

The item in question is listed at $799 by them originally which I paid. If I was to go buy the item now, which I can, the next lowest price I can find right now is about $5000. Guess what that means? Yes, they will be force to pay the difference. It is certainly worth my time and energy to pursue this litigation. Which since this is a clear breach of contract, I can get a lawyer to go after it probono pretty easy. Again, they are forced to pay the damages of the broken contract for which I had to rectify. Then punitive damages on the difference, including costs, mental anguish for not having a "gift" when promised by the holiday season... yah they are fucked. It certainly won't cost me a dime to go after this in court. In fact, I stand to make a bunch of money. This is also something that might be class action as well if it is wide spread enough. They are hoping people are lazy and roll over and let them break the law. I for one am not.


And the only way to secure that obligation from them is to take them to court. That was my point. They know that and they know you won't do it. And there is no way a judge will give you punitive damages for mental anguish. If there is I'll eat my left sock.

Look, I'm on your side on this, but there's not much you can do unless you take them to court. And it will cost you time and money. There are filing fees, discovery costs and then they will send lawyers who will delay, delay, delay and then hound you to settle most likely.

Hmm, Target canceled my Black Friday PS3 order, perhaps a prestigious law firm will see a blank check opportunity in this sleight on my honor :hmm:
