Imagine if this happened on a bunch of stocks instead? I agreed to and paid for a bunch of stocks at a set price. Only to have the company come back a month later and say, nope, here's your original money back. By the way, if you want the same stocks, they are 10x's that original price you thought you paid a month ago.

Same premise, same concept, just a different item. Instead of a firearm, it could have been anything. The point I'm making is if people let this happen, it will continue to do so. If no one does the right thing, eventually companies will lobby to get the laws changes since no consumers care if they get screwed over.

As for being a gun nut, I'm far from it. In fact, this was my first gun purchase ever.

No, it's a breach of contract and illegal. How about if you had purchased a bunch of shingles to roof your home before hurricane sandy hit your house before the item could be delivered. And instead of delivering shingles you could use even more for your house, the company decides to refund your money instead. And now you are forced to buy them on a market that is price gouging for that item.

You don't NEED shingles for a house. You can certainly use other materials to accomplish the same thing. But the premise is certainly the same.

So in the weeks leading up to Black Friday, anyone that wanted a Black Friday item could come in, pay the Black Friday price, and have the item picked up at the store at a later time.

While the OP's situation doesn't matter to me, I do find the above odd and can hardly believe a company can be so poorly run.

You run a popular item at a huge discount expressly to get people into your stores to buy more crap they don't need. Letting them reserve it in advance and pick it up whenever they want completely defeats this purpose. You're just selling an item at a huge loss.

AWhich since this is a clear breach of contract, I can get a lawyer to go after it probono pretty easy. Again, they are forced to pay the damages of the broken contract for which I had to rectify. Then punitive damages on the difference, including costs, mental anguish for not having a "gift" when promised by the holiday season... yah they are fucked. It certainly won't cost me a dime to go after this in court.

Speaking as a legal professional, you will NEVER get any lawyer to take your case. It's simply not worth it to them. A limited civil case in California is $10,000 and up. You are at the small claims court level. How many lawyers do you know that will take a small claims court case?

But let's assume you magically find someone shmuck desperate enough to take your case. I'm simplifying things, but let's assume using round numbers, your AR was about $730. Currently, Turners is taking deposits for a similar Windham Weaponry AR for $1000. Hence Dicks can show your damages are around $270. You are NOT going to get any thing for mental anguish or punitive damages. They'll laugh you out of court for asking. A lawyer will get one third of that $270 for his fees, netting him a whopping $90. How many lawyers do you know who will open a case for $90? This is of course assuming of course that you win and the court doesn't lower your award by the value of the gift card. Out of the $180 left over, you'll be paying $50 to file the case, plus whatever administrative fees your lawyer decides to charge you. In the end, you'd realize you were better off with the $100 gift certificate and learning to deal with it.

Try triple at best. Crap $700 AR's are going for $2k if you can find one actually for sale. This is an $1100-$1200 rifle that is fairly rare to boot. I'd say your looking at $3k if you can find someone who'd actually sell it. This current environment is unlike one I've ever seen.

I always have good experience buying from Dick's, I bought 2 guns there, and would do so again. That said, I wouldn't buy AR-15 at Dick's, selections and inventory are very limited. AR-15s are hard to find at any local gun store in my area.

Honestly they were probably having problems getting the AR-15 for that price. They weren't planning on so much demand.
