Domain Name taken but not used

Not entirely sure this the right forum for this but here goes

I have a patent and a trademark on a name of a new product but the domain name is taken.

The Domain Name has never been used and the owner has just renewed the name for 8 more years. I have tried to email them but no reply, he is just holding the name

If it matters I am in the US, he is in the UK

Do I have any options in obtaining use of the name or should I just move onto a similar name it would then not match the product and trademark

Move on. There are lots of valid uses for a domain name besides commercial or even web. Perhaps it is someone's personal domain that has some meaning for them for entirely personal reasons or whatever. The US is not the UK. Your patent and trademark probably don't mean much there anyway, and obviously the patent has *nothing* to do with a domain name, and a trademark also has nothing to do with it in most relevant situations considering the national difference and no apparent conflict of commercial rights / interests.

you could offer him lotsa cash for the domain and hope that will solicit a reply

if you have cash, of course

If a domain is not active there is Nothing you can do about it.

As funny as it might sound, if it is active and use for business that is competing with your patent you have more of a legal recourse.

In any case you can look at similar domain with .net, . us, etc., you can also make a small change (by just adding or changing one neutral character) and get .com.

Like instead of book.com, books.com, or A-book.com

It has never been used for any purpose, he is just sitting on the name

Unless he is willing to sell it to you, there is still nothing you can do.

I know there is a way you can file a legal document and get it taken away from its owner if it's not being used.

My boss has a lawyer client that wanted a domain name, but the squatting owner wouldn't sell it. The lawyer offered him $300 for the DN, he was rejected, filed the proper paperwork for $300, and got the DN.

I think the catches are that the domain name has to be pretty much your company name or brand, and the other company is using it to profit.

Yeah, but it sounds like the Domain was registered BEFORE the OP created the "new product". That wouldn't be Cyber-Squatting.

Believe it or not, but I don't believe that matters. First to occupy a domain-name doesn't really matter, if the domain name has a specific commercial interest.
