I bought Assassin's Creed off someone on eBay. He was 1 week late in shipping it and upon receiving it, I decided to give him positive feedback after 30 minutes of playtime (I got a rush of excitement seeing the package since it took forever for it to come - This is why I'm stupid).
I put it into my xbox360 and then after 30 minutes of playing I decided to leave him positive feedback (as stated above). After another 30 minutes or so, the game freezes. I just restart the console and start playing again. After another 1 hour or so of playing, the game freezes (this time with an error of CD UNREADABLE).
I opened up the cd-tray and flip the CD upside down where I see 2 huge cracks near the spindle part of the CD. My xbox360 doesn't make grinding noises and it has never broken a single cd to date. I quickly get on eBay and inform the seller that there are 2 huge cracks.
He says that if I ship it back to him, he'll inspect it, and if it indeed is broken, then he'll refund me my money. He received it today in the mail and has told me in the Paypal claim that the CD is completely broken (not totally but it doesn't even play) and because of this, I'm obviously the culprit since I left him positive feedback and then complained around 2 hours after leaving him feedback. He also stated in his last statement that he retracts his previous offer of refunding my money after receiving the broken item and is willing to ship me back the broken item.
I told him that it works on my xbox360 (besides the freezing every 30 minutes - 1 hour) and that because it doesn't work on his xbox360, that shows that he probably broke it before shipping it to me and then broke it again after I shipped it to him. I mean, it's obvious that his xbox is much worse since it can't even play a semi-broken cd while mine can.
I have escalated the transaction to a Paypal claim and hope to win the case since it's complete bullshit what this seller's doing and i'm a complete moron for leaving him positive feedback (but in my defense, I tried out the game for 30 minutes first).
By the way, my gamertag shows that I played the game for a few hours - this should be proof enough but he thinks I already own a perfectly working copy.
