I guess I'll at least get advice on it.... I mean, the reasons they put on paper were total crap and I can disprove them. Just seemed convienient to me to, right after Eid, let me go.

By the way guy, here is the email I typed PRIOR to getting fired. I am omitting details because it's not appropriate but you'll get the jist of it.

Hey ----,

I didn?t want to write this email to be honest, but I am at the point where I feel I?m pissing off MR X with a lot of things that go on, and given that he?s my next manager? I am putting myself in a bad place. First, I had Ramadan which isn?t really avoidable on my end. I told MR X and MR Z about it well before it happened. And when I told MR X I had to go for religious obligations (similar to what Fridays are like for you), I got a very sarcastic ?whatever? in response. Ramadan is over now, and I can work as needed.

This morning, I was talking with MR Y about Sharepoint migration and what he would need of me on the migration date. The conference call started so MR X told me to get on the phone, which I did. At the same time, Kevin had me getting quotes for SQL server and I was trying to multitask and to no doubt, because even COWORKER IMed me about it? MR X was upset.

I am really at a loss here. I am capable of doing the work for MR Y, MR Z, and MR X, but I can only listen to one person at a time. However, when I have to pass on what MR X needs, to get MR Z's tasks done (as MR Z is the priority per you), I am obviously making MR X upset, and as I said, him being my manager as well? it puts me in a tough spot. I am not going to apologize for my religious obligations and I honestly wouldn?t have mentioned it had MR X not given me a hard time about it. I am sure that if somebody else said they had religious obligations that it would be accommodated. I am unsure why if it is me, that I get sarcastic responses and the ?we need this done right now!? type of attitude. When we had the Track-It setup, there was an hour I was unavailable and later MR X mentioned to me ?You should have stayed on it only took 4 hours?. There are so many hours in a day, and while I could work in the evening, on the weekends as I have been for making sure MR Z?s tasks and MR X?s tasks, and MR Y's tasks get accomplished, I really didn?t think this would stretch out at long as it has.

I am not sure to whom I can go other than you to mitigate this. I am sure MR Y and MR Z will understand if I tell them well in advance about a religious holiday (of which there aren?t a lot), but MR X has a distinct insensitivity to me in this regard. I would ask that you not tell MR X about this, but I am sending this more to make you aware of the situation. I have never been one to use the ?cover your ass? type of conversations, and it?s probably gotten me in trouble not being something of a politician about it? but I feel you need to know what is going on, and the situation I?m in, even if there is no immediate remedy for it.

Sorry for the problems? lots of hats to wear and only one head

It really might be to your advantage to hire a lawyer to contest your unemployment. "Fired" It's my guess that they'll try to twist up your words to deny you benefits. I've seen this before more than once.

Look on the bright side, you can get really hammered tonight and not have to wake up early tommorow.

I don't drink :\

You could start drinking now. Blame your inability to show up at work on alcoholism. That's why you were sick. Offer to go for rehabilitation. Alcoholism is an illness. They can't fire you if you're disabled. After all, you even offerred to seek treatment. Take your vacation at rehab. or file complaints of discrimination based on the Americans with Disabilities Act. Watch some movies like "Ray Milland's The Lost Weekend," so that you'll know what to talk about in group during rehab.

Well.... were you actually sick? I dont get it. if you were actually sick I don't think they should fire you.

Yes, migraine with the flu. I was out for two days..

did you go to the doctor and get a note?

No... I'm not in high school. I went to the doctor, he gave me some OTC meds and I kinda knocked out for that day. I was drowsy all day.

If you go to the doc, get a note saying you were there and what is wrong. Have the doc put down that he prescribed a few days of bedrest. .... ALWAYS.

It is illegal to fire someone with a doctor's note.

Not in a right to work state. Here you can be released from employment for any reason. Not sure if his state is right to work or not.

Are you implying that OP can be fired in reltalliation for a religious observance and not have to justify their dismissal because he lives in a right to work state?

Not to mention if OP called in sick and then produces a note from his doctor that he did indeed seek medical treatment.

Dont confuse a company that is unhappy with your performance telling you one day that they no longer need your services letting you go without specific cause becasue it is a right to work state, with firing you for unjust cause.

Right to work is not a defense for a company firing an employee for legitimate absenses.

If the supervisor did indeed harrass OP, if there is indeed internal email discussions about OP being harrassed, my crystal ball says

OPs boss will be fired, OP will receive back pay, OP will receive his job back or negotiate a settlement when he tells this company that he no longer wishes to return to work.

OP, file a complaint with the dept of labor. Consult a lawyer if you dont get the proper response from your company.

File for unemployment there are situations where you will not be denied benefits when you quit or get fired.

Just pointing out that in some states the company does not need a reason, or that reason can be just about anything. I wasn't implying that is what happened to the OP. In my state, Idaho, which is a right to work state, a company can require you to sign a form that states you can be dismissed for any reason, and you in turn can quit for any reason. That is one of the things we got with our right to work law when it was passed about 15 years ago. I worked at a semiconductor plant a few years ago and one of their policies for all new employees was 1 emergency day for your first 6 months of employment, miss one day past that for any reason and you were canned, and it was totally legal. In fact it happened to a few people who started the same time as me.

To the OP, sorry hear what happened, good luck finding another job.
