Another update from woot's community that says there may be an upcoming investigation:

Our initial reaction:

Woot of course denies any wrong-doing in this proposed infringement against MSI. We do not believe that any cards transacted were 'stolen merchandise' -- we transact only with reputable manufacturers and vendors. We will of course cooperate fully with any investigation that is called for. Obviously, we feel harm has been done to our reputation with this claim and we reserve all rights to defend ourselves with further action.

To our members, We would like to take advantage of this opportunity to extend a 2 year Woot direct warranty on all purchased OEM-MSI video cards, un-real/imaginary as they may be. Unfortunately, as we do not have the support of MSI for replacement cards, this will continue to be a full refund only warranty from Woot. This has been automatically implemented on your purchase.

We will update here, or via email as necessary if there is any news.

Thank you for your past and continued support.

UPDATE 11:45am: We have proactively sought out and heard possibility that a real investigation may in fact be ongoing here... The language of this post was written during our initial disbelief of this possibility. As you can imagine, we're actively seeking information, due to lack of any direct communication. If any facts emerge, we will update.

A company extends a full money back warrenty to an OEM product that was never warrentied from the MSI to begin with. That shows sohigh level of dedication to thier customers. Again for the record Nessism an idiot.

You know nothing about whom Woot dealt with, or whom that broker dealt with previously.

From what i read on another forum, Dell PC's that have an MSI 7900GS resemble the type woot sold, (green pbc, same heat sink, etc.)
If MSI's up there claiming that these are stolen because of that description, how does it explain what dell has as well?

A better question is, why are you defending Woot?

Because Woot has not done anything bad before. Plus they are being honorable by extending refund warranties on card.

But nah, you don't bother looking for real evidence that I did, nor did you bother reading what I wrote (and it was in jest too). Everything is conjecture from you and that's fine and dandy to you since you file conspiracy as fact.

But that doesn't suprise anyone here because obviously you made up your mind about Woot without any evidence of any wilful or malicious wrong-doing on their part. Same tactic you pull with me. You just read my response to you and made up your mind on my intent (defending Woot, apparently).

...because obviously asking someone if they work for company A surely implies I either work or am defending company B. I mean, there's no middle ground or grey areas there.

Maybe, just maybe I'm defending logic and not Woot? Maybe, just maybe because these accusations have yet to materialize to a point where we understand what's going on; where Woot themselves know exactly what happened, I won't buy into any conspiracy games yet?

But no, none of that makes sense...

brokers are where a lot of oem stuff comes from. where do you think geeks.com gets half their stuff?

that said MSI is a huge oem, and has been manufacturing oem version cards forever. i wouldn't doubt at all that the card in dells are also MSI brand or asus brand oem cards.

oems do not want a flashy blue pcb or crazy looking gold fans in their machines. and evga cards generally also look just like the reference ones especially on the initial release. i would commend woot. even if they did buy it from a shady dealer, that is how they get us the deals. and whos to say they didnt get the cards from a reputable dealer who was sold them by a shady dealer.

Wouldn't one shady dealer in the reputable dealer chain turn all dealers into shady dealers?

If a reputable dealer deals with a shady dealer, that reputable dealer becomes shady, and the reputable dealer who deals with that previously reputable/now shady dealer also becomes shady. Therefore woot is guilty and should die.

Actually their revenue is $40 million, which means they moved $40 million of product. However, their profits are obviously not $40 million since I highly doubt they have a 100% margin (unless they actually steal everything they sell, lol). No clue what their margins are though.

If Woot is actually the innocent one here it makes me wonder why they are so defensive and all of a sudden extend their miniscule 90 day warranty. If they are innocent they would openly help MSI about this situation.

If they are then they can't read and their anger is misplaced, because the 90day warranty was clearly with woot- not MSI.
Manufacturers never warranty OEM boards unless bought from authorized dealers/distributors anyway, and even then they often make you go through the place of purchase. Whatever numbskull thought he should call MSI about his OEM prerelease board for support needs to find a different hobby than PC upgrading.

That doesn't follow at all. They wouldn't be extending the warranty at their own expense if they thought they had done something illegal. They would be covering it up as best they could most likely.

Most likely, these were grey market cards that ended up not being used by an OEM like Dell or HP and made their way through the channel into Woot's hands. Worst case, they "fell off a truck" and Woot purchased them from an unscrupulous dealer.

MSI is probably more pissed that grey market OEM cards made it into the retail channel than whether they were "stolen" or not. Unless someone stole an OEM shipment directly from them, they already got paid for those cards.

There are quite a few different things that stack up poorly in defense of Woot:
The cards in question were offered by Woot before the actual release of the card by nVidea, according to page 1 of this thread. The price was also well below expected market price. In most industries OE manufactures, like MSI, build orders for their major customers, like Dell for example, before filling the secondary channel for independants. It seems highly suspect that that MSI would be sending OEM cards over to a general purpose distributer weeks before the actual product launch where a company like Woot can purchase them. My guess, and yes, it is a guess, is that Woot did purchase the stolen cards unknowenly, but it also seems that they choose to ignore some pretty obvious facts like why are the cards so cheap and why are they available so early.

The card has been available in OEM systems for quite a while before woot was selling them. It was before the RETAIL launch of the card by Nvidia, which is probably why this is an issue at all. I.E. Nvidia is pissed at MSI for letting cards into the channel before the release date they specified and MSI is covering their a$$ by talking about it being an issue of theft etc.
