This may be a privately owned forum, on a privately owned server, owned by a bunch of privates but, and it is a big but, it is wide open to the public 24/7 and therefore falls under the protection of the 1st amendment regarding free speech and free press.

The servers do not belong to the public. Electronically speaking, we're visitors - therefore what can and can't be said here has nothing to do with your first amendment rights.

Just don't come here if you don't like the rules. There are plenty of other forums out there.

Sure.. and just go ahead and swear like a sailor and make pig noises to the police while you're at it.. hell the First Amendment allows you to say anything you want anywhere you want according to how you think so go ahead..

Dang.....another First Amendment expert. Seems we didn't have enough of them around here already.

So what if the &quot;doors&quot; are open to the public 24/7? By entering said doors, you have agreed to abide by forum rules and such.

It'd be the same as you entering my store....it's open to the public. You can come in without invitation, but start excercising your right to free speech in a way I find offensive and you'll find yourself on the outside looking in. My perogative....my shop. Same as here....Anand's servers, Anand's shop......he sets the rules.

Excercising free speech does have its consequences.

In the technical terminology of law, a place like the AnandTech board, which is privately owned, but which invites the public at large, would be called a &quot;quasi-public forum&quot; (the term &quot;forum&quot; is used in a broad legal sense here.)

You do not have an absolute right to any and all free speech in a quasi-public forum. And you should be careful what you wish for. If you had the freedom to say anything you want here, you wouldn't like the place for very long, because foul-mouthed, abusive hooligans and annoying spam-artists would surely swarm in to take advantage of the same free speech that you would like to claim for yourself. Look at what happens in unmoderated newsgroups.

You don't have free speech. Your one thread got locked because a NEF has been covered a million times already.

You can't sue. This is AnandTech Inc. Their servers, programs, and information are all owned by them and their partners. You view these forums or the website. YOU choose to. You can also choose to stop visiting if you don't feel you've been treated fair.

You just CAN'T bitch about this not being a privately owned site, because it is. And the owner and his employees/helpers can choose what's best for the site.
