you have a lawyer or know one? get him to write up some papers and threaten him with lawsuit. also contact local police where he lives and explain what he did. hopefully they will make a phone call for you

Make sure you stay in contact with Vertigo Acid. He is a mod at Hardforum and he has said he will try to help you. You need to have the Hardforum mods look into this as the trade happened at their forum. He has already posted in your thread.

from reading what he posted on hard i would say somebody needs to get the post office to deliver the package. why is it setting there not delivered?

Is the package still in Bethpage? If it is, I could try asking the PO what's wrong with the package.

another red flag to me would have been he has 1 negative heateware evaluation already. he would have shipped first for me or no deal

really, yes according to the confirmation number it was last scanned at Bethpage, I have no idea where it went from there.

UPDATE: I talked to the guy over the phone and we're on the path of working something out.

I don't post a lot. I lurk a lot and this thread bothered me.

There is just way too much buyer entitlement in this thread. If I would've done a trade like that and something went wrong with my shipment. I would've handled it and took care of the buyer accordingly. There is no way this would've went on for over a month.

If for some reason the buyer wanted all the information to process the claim and requested the receipts from the POS to handle the situation and for some freakish moment and lost all of my brain cells and I consented to his wishes. At that point, the buyer assumes all responsibility and I wash my hands of the situation. There is way too many ways for me to get screwed in that sort of situation.

You're an idiot. You probably shouldn't ever do any trading on the internet ever again.
You might want someone to purchase things for you in person too. I don't think it's safe for you to enter into any contractual obligations on your own. I know this message seems cold and callous but its a cruel world and I don't want to see you get burned any worse than $300. You should've never requested to handle the situation and you definately should not have requested the receipts.

He might get a negative feedback on this one; he has a good reason not to. I personally, think that while he shouldve been more proactive on making sure you got your package. I also understand if he washed his hands of the situation when you requested to do the claim.

You don't have a leg to stand on as far suing him or anything. No one could prove that he had an intent to defraud, he has enough evidence to the contrary. The best thing you can hope for this is the guy decides to split the loss with you, or the USPS steps up and pays out the claim.

A buyer is at least entitled to thing he paid for; he hasn't got anything in return for the product he sent in trade. Yes there is some miscommunication but shit, until the item is in his hands it should be the seller's responsibility.

regardless of if the OP requested the receipts it is up to the seller to make sure the person he traded with gets the package. the seller is being lazy in not fulfilling his obligation. he received his end of the deal with no trouble and he should make sure the deal concludes successfully. if you look at his heatware you see that he already has 1 negative listed so that would have sent red flags up for me.

Let the shipper handle the claim. He knows the specifics about the packaging, drop off, etc. There's never any reason why the buyer should handle this process.
