I'm pretty sure, since nullsoft has the rights over the code, and the release was unauthorized, therefore essentially stolen software, they can take it back. It's sort of like the linux kernel/sco thing. Just imagine that there *really was* sco-proprietary code in there, linux kernel developers can't just say "well, it says right here at the top of inet.c (whatever) that it's gpl, so suck it! It's free forever now!"
Justin Frankel is leaving Nullsoft. Thank god for that. Waste sounds cool. It's GNU I think, but I hope it turns out better than Gnutella.
AFAIK, nullsoft owns waste. If that's the case, he can't do anything with it (and probably shouldn't even have it, but you know he does )
