That newegg drive is oem. This one is retail. Try getting WD to replace an OEM drive, I haven't had any luck with them doing it in the past. They want you to go through the reseller.

I've bought one 120 gig SE drive from newegg, was OEM, but said it carries a 3 year manufacturer's warranty.
I checked the WD site to make sure once I received the drive, and it was covered (checked serial num).

Even if its not, Newegg has a pretty good RMA system.

I have bought OEM Seagate and WD drives from Newegg and confirmed all the manufacturer warranty on the respective websites. Never had to send one in, but it certainly looks like the manaufacturer recognizes the warranty.
