Why? If she was drinking water would it be a lawful order to "stop drinking that water"?
Does an officer have to give you the reason for your arrest if you ask?
She could have been polite and put out the cigarette. She chose to be an impolite criminal that acted belligerently and told the police officer what he could and could not do. Black people just cause their own problems trying to be uppity with a police officer. This may sound like I am against Black people, but I am only trying to show that this is not the way civilized people act. If you resist arrest, the police are required to take their response up to the next level.
All she had to do is put out the cigarette and be polite. She would have probably been issued a ticket and left on her own.
Of course they wouldn't. That complaint is completely retarded. Just like not complying is retarded. But we have to talk about it because....conspiracy. If she didn't die later in jail, no one would be even hearing about the traffic stop.
Not illegal, but if the smoke is used for covering up the order of something that is illegal (weed, alcohol), you are then suspected of interfering by smoking.
The complaint is as stupid as the initial order.
If the cop didn't like her smoking, he should just put up with it and then complain about it later. Isn't that what everyone is supposed to do?
Yes.*
*If, for example, he needs her hands or mouth to be empty or her undivided attention at that time.
Basically, any order could be considered lawful under the right circumstances. That is unless the order it telling someone to do something illegal or could cause harm at the time.
yes.
The stop was all but over. The story I read said she had already received her written warning. He only requested the cig out after she said she was irritated. He was planning on arresting her at that point and wanted the cig out as a precursor to getting her out of the car.
All she had to do is put out the cigarette and be polite. She would have probably been issued a ticket and left on her own.
Get on your knees and start sucking, citizen.
Don't worry, you can file a complaint later.
It is all about attitude. If you act aggressive and threatening with the police, they will suspect you are committing a crime and treat you accordingly.
Part of the problem with that line of thought is that the cop can keep trying to escalate. You can see it in the video where he nit picks about a damn cigarette. She doesn't have to put that cigarette out. If it wasn't the cig, it could be the headliner sagging or the "tail light" or whatever else. The man was on a power trip and nothing was going to stop him until she was in cuffs.
Its sad to see someone's insecurity and thin skin affect normal civilians like that.
That man needs to be off the streets and obviously can't take the stress of the job without escalating situations. He's a danger to himself and the community. Civilians shouldn't have to tippy toe around Deputy Badass.
Not an unreasonable request considering cigarette smoke is toxic. If I'm a cop or anyone for that matter that has to stand by the window of a car where the driver is smoking, it's not unreasonable to ask them to put it out. Second hand smoke causes cancer.TROOPER: "Do you mind putting out your cigarette, please?"
Actually, she does. Lawful stop on an arrestable offense. In Texas, I believe its actually an arrestable offense.BLAND: "I'm in my car. Why do I have to put out my cigarette?"
TROOPER: "Well, you can step out now."
BLAND: "I don't have to step on out."
F that. The cost of cigarettes is already ridiculous because of greedy fucktard politicians overtaxing them. Let her finish it.
Stupidity snipped.
To you... A white middle aged lawyer. Black people have a lot of resentment towards police and for good reason. Police should probably understand that at this point and walk on egg shells around black people. Enforce the law but don't go all respect my authority on them.
Again this is another case of black lives dont matter. If you think the next traffic stop is going to be any easier you are mistaken. You can only segment and prey on a minority population for so long before they stop giving you respect.
But its not stupid to disobey it and further escalate that disagreement to assault, amiright?
So you're saying you CAN refuse a cop's order? Please, enlighten us. What's the line? When do we follow orders and when can we choose not to follow them?
The video doesn't support that. He was walking back to the car with paperwork in hand at the time he question her irritation. He asked her to put out the cigarette then. He didn't order her out of the car until she didn't comply with his request to extinguish the cigarette. Again, the video doesn't support your narrative.
Maybe cops shouldn't be so stupid to order people around just to prove they're in charge and escalate things to violence unnecessarily?
Why do you and some of these other people in this thread insist that it's always the citizen's job to placate the cop's attitude? Because they have a gun? Might makes right, great attitude. Surely the founding fathers would cheer on this kowtowing to the man with the gun.
Most white people would get out of the car because their rights arent under constant threat by police. As I said police around the country need to understand that they have a pr problem and if they dont care about that then they are going to find themselves under fire. People will resist. People will fight and they will die. But they will be doing that to fight for their rights.
Why do you insist that this woman's actions were reasonable and she isn't responsible for what happened?
