I'd say the guy leaving the 7-11 was at fault for not checking for oncoming traffic before pulling out. But of course since the traffic wasn't supposed to be there, maybe that's the guy who's at fault. Guess it should be that they are both at fault and shuld pay for each other's damage.

It depends on your states laws but in general crossing a double yellow is illegal in most states.

It was the 7-11 guy's fault. I know cause I was him one time many moons ago.

I was 17, pulling left out of a parking lot in the exact same fashion as you have diagramed there. The road was one lane each way, a car was slowing down at the curb to turn right into the lot I was coming out of. I pulled out to turn left, bam, car that was behind the car turning right had moved over slightly to get around him. I didn't see due to the turning car obstructing my view. I was lucky though. 0 damage to the lady's car, $1000 to mine. Nothing major.

The insurance lady said you can't turn left over a double yellow or painted median at all. No matter what you're fvcked.

Learned a lot from that though. Made me much more careful and made me realize how dangerous cars really are, even though it was minor. That was like 6-7 years ago and I've not even come close to another accident since that wasn't due to some n00btard driving like a fvcktard.

I think everyone who says the 7-11 guy is at fault is correct. I've been in that exact situation before and I was the one pulling out into traffic and I received the ticket.

Both are at fault, insurance will split the cost. However I bet the 7/11 guy would have to pay the most. He could have easilly hit the blue car (by cutting in front), red truck (again by cutting in front it doesn't matter that they were stopped), grey car (doesn't matter if he was over a bit or not), or the white fan (assuming that right fan turned to the right), or the other red truck (assuming the second red truck turned left at the light). Pretty much the guy going out of 7/11 was guaranteed of an accident by cutting in front of 5 cars. Thus more blame.

What? If they're stopped at a light and they left room for him to get out, how would he be guaranteed an accident with any of them? They'd have to let him pull out then intentionally ram him for that to cause an accident.

If it were my decision, I'd say all blame goes to the guy driving on the wrong side of the road, but I have no idea what the law says.

If the the cars stopped at the light, leaving enough room for the car to come out of the 7-11, assuming it was a legal left turn... how in the world could the car make a legal left turn and expect to find a car coming at him on the wrong side of the road?

As far as I know, you are allowed to make a left turn out of that 7-11 parking lot

Ha, love the picture!! I'd say the 7-11 car, but then I'd just say it was great living in a no-fault or rather, no right-of-way state. Well, now that I think about it, the other car!

Where this stuff really gets dangerous is when the people in the first 2 lanes are "courteous" and let kids cross the middle of the street, and then something like this happens. That's why they have right-of-way to begin with.

So it's illegal to go across the double yellow but it's ok to ride halfway on it and in a traffic opposing lane?

The guy on the yellow lane shoulda saw the HUGE gap between the cars and knew that someone was coming out. I woulda did the same thing the 7-11 guy did, especially since that guy would be rushing to catch the gap.

I almost had the exact same type of accident happen in front of me. I'm approaching the red light and I am about 4 cars away from the intersection. Out of courtesy, I leave a gap in front of me for the gas station exit (situated just like the 7/11) The guy leaving the gas station acknowledges me and is slowly creeping out for the same type of left turn. In my driver side mirror, I can see someone barreling down at least 75km/hr in the on coming traffic lane to get into the left turn lane. I quickly wave off the guy leaving the gas station so he doesn't get T-boned. In my story, it's most definitely the idiot speeding in the incoming traffic lane that was at fault if an accident were to occur.

If you're not supposed to make a left turn over a double yellow line, what are you supposed to do in that situation -- make a right turn, and find somewhere to make a legal u-turn (illegal at many intersections)?
