serious lease problems w/ roommate

Here's the scenario:

3 weeks before the end of the lease, I talked with the leasing office about possibly leasing another apartment. I asked them if I needed to give them a notice of leave since I was considering leasing another apartment. They told me no, that if I decide not to rent from them it's no big deal. After two weeks (a week before the end of the lease) I decided to rent a house with a roommate (a new roommate). I went to the complex and they gave me papers for my old roommate and I to sign. I didn't read them well, I signed them and left them with a note for her to sign them. Afterwards I gave to the apt people. She called the apt complex 3 days (1/28) before the end of the lease and asked when she needed to leave. They told her we need to be out by the first of the month. On the 1st, she went to turn her keys in, and they told her she "hasn't given a 30 days notice, and you still have 30 days left to pay (as in, another month past the lease date..) She was all ticked off, but signed a 30 day notice (agreeing to pay 30 days more rent, even though someone from the apt complex TOLD her to be out by the first). They also told her that those papers we signed weren't any kind of notice, that they released ME of all liability (roommate release forms) and that I wasn't liable for the rent anymore, nor the 30 day notice.

So, she calls me FURIOUS wanting me to pay ALL of the rent for the next 30 days because I didn't tell her what she was signing. I told her to fsck off. She wants me to pay at least half.


What do you think? Am I responsible? I talked to them in advance about what to do about leaving, she waited until 3 days before the end of the lease. She assumed those papers were releasing HER from the lease as well, and didn't read them (granted, neither did I)

No pics, she's not hot, etc. etc.

Cliff notes:
Roommate signed papers to release me from the lease without either of us reading them, now she is being forced to pay another months rent and wants me to pay half.

no, because even though you probably should have both read them, her not reading them resulted in her expense. she should've been aware of what she was signing.

Sounds like you only gave 3 days notice to everyone....

Your leasing company more than likely figured someone would have told them not only you, but also your roomie did not plan to renew.

I somehow can't see how your leasing company did not ask if you roomie intended to vacate as well...

either way your roomie would never have agreed it seemed to be stuck with the whole bill alone.

Ethically you should split all the costs again for the last month, whether or not you live there (your roomie could also find a temp place to live and ultimately although neither of you are living in the apartment someone has to pay).

Well, I feel like I should have to pay *some* but not even half.


I talked to the complex 3 weeks ahead about possibly renting another apt. They told me I didn't need to give them any notice, that if I ended up not renting it then no big deal. (I didn't tell my roommate any of this, I honestly thought she'd give her own notice. I don't really feel like it is/was my responsibility to tell them that my roommate isn't staying there.

I watch enough People's Court to know people should read everything and anything they sign. I don't think you should have to pay anything unless you just want to be nice.

Although just out of curiosity, what did you write on your note for her to sign the papers? Just "sign here" or did you write something more specific like "sign this, its the termination of our lease."?

I really don't remember.. I think I just wrote "please sign the paper on the table" or something like that



She wasn't that great of a roommate, but she's a so-so friend. I dated her a couple years ago, and she can be a HUGE b!tch.

I'm not SET not to pay.. I don't feel like I should, and my friends agree... I want to make sure the "general" public agrees or disagrees..

You do not need to pay. Unless your former roomate has a reputation for revenge and knows where you live.

as a apartment renter for over 6 years (5 different apartments), I say you always no matter what give a written 30 day notice. You simply can't just rely on some words a schmuck sitting at the office says, when it come to money you always take care of business. In your case, you informed them verbally (a week late) and they told you verbally. Did you record any of it? Where is your evidence? Did you get it on paper? This is why you don't screw around when it comes to important stuff.
I say you should pay half. It is partially her fault as well for not being on top of things too. But I suspect that she probably trusted that you knew what to do, guess she was wrong.

probably should help out a little - if not half then at least something. when you told her you were moving out did she already know she was going to leave too? if so, i guess she assumed the complex knew you both were leaving.

however, you didn't give 30 days notice (sure, 3 weeks is more than 3 days) and the complex didn't charge you cause you were talking with them. she has a case to take up with them there.

I think what I will do is pay 1/2 of my monthly rent. While it may be partially my fault, I don't think it is at all my responsibility. She should not have relied on me. I never told her I would take care of it, nor was it implied.

What happened was that she assumed that the paper she signed relieved her from responsibility. However, I TOLD her she needs to let the apt people know. I made SURE that my bases were covered to avoid a situation like this. Blech.

how much is the rent? I think you should at least pay half. just don't screw up your housemate....
we got jacked by our housemate before, now we have to suck up the utilities cost and go after him.

she won't be my roommate anymore.. She is a horrific b!tch, and I had to clean up after her CONSTANTLY. She had wierd people SHE didn't even know staying over..


Bleh. It's hard for me to look at it as being 50% my fault. 25% *maybe* but I guess I should deal and pay 50%. blech.

You don't have to pay, but you might help her out with 1/2 rent. In no way should you pay the entire amount. Let her know you are helping her out, save this favor for the future. See how she reacts to that, if she's still a b!tch about it, then don't help her at all.
