Should these tenants be evicted?

Slap him with the late fees, and let him pay on the date he decided. If he still doesn't pay evict his ass, if he only pays the rent and not the fees then keep piling up the fees until next month, and remind him that if he fails to pay he will be evicted.

My landlady is 93 years old and acts like my grandmother, some months I'm a day or two late if I'm busy at work, she never complains and I always make it up to her.

I stopped reading there.. He doesn't make the rules - YOU DO. It was in the fine print (I'm assuming). If you don't evict now, make him pay the late fee and give him like a week. If not and he's still adament about not paying the tacked-on fee, kick him out.

If he's paying $849 to begin with, then he certainly should be able to afford it every month regardless of personal situation. I say tack on a late fee this time around, and if he refuses to pay it, THEN evict him.

Sounds like a deadbeat eBay seller that Maetryx helped me bust. Later he defaulted on several auctions, and claimed he didn't contact the people whose auctions he won because he was in the hospital for a week. Well, apparently he was able to keep bidding on other auctions while laid up, he just couldn't contact anyone and pay them.

Slap him w/ late fees, until he can prove the car was stolen. I'd say give him an official written warning and the next time he's gone

I have been in the same situation and the problem is, once you start the eviction process, you will not see a dime from them. I try to work with people like this by offering to take a weekly or bi-weekly payment (whenevere they get their paychecks) Encourage them to find another place and get as much out of them as you can, but most inportantly get them out! I have even gone so far as to say " if you are out by the 15th, I'll forget about the back rent. Getting them out and getting the place rented is your top priority. If they think they are better off leaving, they have less chance of destroying your property on the way out. Do you have a security deposit? If they ask for it back, tell them you will have to see the condition of the appartment before you release it. After they are out, keep it, and if they complain, tell them you will give it back when the back rent is paid.

I'd play the 3 strikes and you're out game. He's used up 2. one more time and I'd kick them out. But let him know that he's used up his two strikes and any other latenesses or anything and you will be forced to find other tenants.

straight up right there.. .. sounds like a plan. I'd tell em there will be a late fee this time since he was late twice already and see if they will pay if not.. ..

Ask him to show you a body of the dead relative and the police report for his wife's stolen car....after that, evict him anyway. No one wants a dead beat.

Sounds like the logical way to go.

Make this the second warning, you worked with him before, this time slap the late fees. Next time, evict.

Eviction is a difficult and costly process. People seem to think he can just kick them out at the end of the month, but it just doesn't work like that.

I'd charge him a late fee and then not renew his lease.

Edit: I'd actually be pretty forgiving if he hadn't acted like a dick about it. Sounds like he things he can walk all over you because you cut him a break once.

He can pay the late fees or move the fvck out IMO. If this was his first time, my opinion would change. You already let him slide with no late fees b/c of your sympathy. I would charge the late fees that are stated in the lease. Tell him the first time there was no penalty, this time there are late fees(as described in the lease) and next time he can live in a box.
