Should these tenants be evicted?

2 months late = Eviction

Late paying rent/lease .... late fee always.

If the tenants don't like late fees they have two choices:

1.) Pay the late fee

2.) 30 day notice and leave.

You've obviously had this rental property dropped in your lap... probably as a gift from your wealthy parents for turning 15. :laugh:

Instead of portraying one side of the situation why don't you ask your tenant for a copy of the police report if you suspect them of lying to you. That will give you your answer better than trying to act like a "big bad landlord" on a tech website, lol.

Regardless of how he obtained his property, what favors does he owe this tenant? What makes this tenant special compared to the other ones he has or others he could potentially have that he should give them special treatment?

Give them five days...

Remind him today, and then in two days... if nothing, throw the three day notice at him.

Having a little trouble believing this is real, but if it is, give them a warning (including this month's late fee). If it happens again, auf Wiedersehen :beer:.

Yep. If he can lease a car for his wife and pay $849 month rent he's hardly making $5/hour. i say kick his ass out.

The kicker for me would be "Did they call prior and explain they'd be late with the rent".
If not, late fees are definately in order.
This would be the last chance at late rent, as well. I'd put it in writing and let the dickhead know in no uncertain terms that he's on his last leg.
If his attitude holds true, he'll move to spite you.
It's win/win if you go this way. If he stays you'll see a newfound attitude, if he goes he takes his attitude with him.
Err on the side of restraint. It's easier on the wallet and renting property is a business.
Take it personal and you lose money.

As a former landlord myself...prepare the docs and tell them to get packing...to me its run like a business...1 late payment ..okay...2 its becoming a habit

Eviction is a nightmare, and like has been said...you won't see a dime of money from him after you start the process.

When is his lease up? Its better to just not renew it/jack the rent way up to get him outta there then. It sucks, because he should be thrown out on his ass for being so ungratful but thats just the way things are.

Hummmmm..........

Lets see if we can put this into perspective....

He is the renter and has problems, he doesn't have the money to settle both and now his problems are to become yours........

I would first tell SNP (subject named person) that he has been given chances before, in order for him not to receive the late charge, have him produce a police report stateing that the car was stolen. In situations like this most insurence companies will give you a free rental for a period of time.
If he could not provide the police report, document every situation that occurs with him, this way you will not have problems collecting from him or retaining the deposite.
I'd give him the 30 day notice to pack his $hit and move along.
If he need cash, tell him to pawn something, get a second job, etc. Put your foot down and do not let things slide, should you continue to do so it will or could look bad for you should you have to go to court to collect the amount he owes you.

Update: I paid the $14 and started the eviction process. Court is scheduled for 8:30am May 12th.

To clarify a few things, they have been with me since Feb. of this year. If they pay their rent w/the late fees I'll let them stay and cancel the court date. Otherwise I will stay with the eviction and sell the property off to a homeowner and get my equity out.

I'll let you guys know what happens.

How late were they the first time? How much is the late fee? how much is the rent?

We are only in May, that is less than three months, they were late once before, perhaps they are having some $hitty luck.

So you are useing the court as a means to collect your monthly rent?

Is the sell of the property because of one couple and possibly that you mis-managed the renters?

at my apartment theres no penalty until the 5th after which its a $25 fine, and theres no legal action until one month overdue.

eviction does take several months. so you if plan on it in the future you might as well start now.

you are a college student and you own several rental properties? maybe they just dont respect you because you are a college student.
