When I was in college, I got cited (not for DUI) because I was walking home drunk. I didn't have anything in my possession, but back then, it was acceptable to cite someone for possession when they admit to having consumed some beer. I wish I had fought that one, just to keep me from having to pay $200 for the worthless alcohol class. VASAP is designed for DUI offenders, but my class was full of college kids who either got DIPs or Underage Possession. I had to do some community service, which I actually didn't mind. Met some cool town folk that way and got to help out a charity that would later make the news because its president was siphoning off funds to remodel his house. The actual people that worked for the charity were very nice, though.
It comes down to being a local money grab, really. I think one kid a few years after I graduated lawyered up and got the bullshit "positive BAC = possession" overturned.
