NBA is a private organization, they have every right to kick him out if they want to.

They can "kick him out", but they cannot force him to actually sell rights or property he legally owns. Which is what he is fighting. He isn't fighting the ban, because the NBA can ban whoever they want.

While I understand this and I fully agree....how does one effectively ban someone from the club if they are still able to own a share in that club?

:hmm:

from what i've heard about his trust, he doesn't have any say in the matter of whether the team sells or not. he's no longer a trustee.

somehow MLB banned steinbrenner from the yankees, which laid the groundwork for the yankees being the best team in baseball for a decade. steinbrenner couldn't muck around with personnel decisions so between competent management and the yankees' traditional fat wallet they were able to develop good homegrown talent and fill in the spots where needed with good free agents.

This is what I have heard. He was declared unfit.

mee two. he didnt ban blacks from games, he asked someone not to associate with magic. imagine if a chick u were bonin' was messin' wit a dude wif aydes, u woodnt want her hangin' wit him eitha. i bet you hes not even near the worse racist among owners. also ownership has to mean something in this country, you shouldnt be able to take someones property/investment against their will, esp if someone hasnt even dopne something illegal. professional sports have actually had owners who are felons (steinbrenner/debartolo) id be a lot more concerned about them

does microsft hire black programmers? so they just changed owners from a jewish guy who hires blacks, to one who doesnt? what matters more when it comes to "racism", words or deeds?

This guy has already won. Will sell his team for 2 billion dollars, plus maybe 1 more billion in lawsuit.

If he can show that his disability (Alzheimer's) caused him to make those statements, the NBA could be in a world of hurt.

Because you can't punish disabled people for being disabled.

this is probably true, and wouldnt be that hard to show given his age and the other interviews he did. his wife could probably cash in on that as well, as shes definitely being financially punished for what her husband said

Last news article I read said the lawsuit has been dropped in the deal to sell the team. Doubt it would have went anywhere and would have just made a bunch of lawyers a ton of money.

As long as the jury is local, it's game over for Sterling.

Report is that Shelley sterling and the sterling trust have agreed to indemnify the NBA against Donalds lawsuit. With that in place he is in effect suing himself.

It's an illegal monopoly, and the courts may decide they don't have the right to take away someone's team.

He doesn't own the rights to shit. NBA owns everything. If I want to make a game called NBA Jam, I don't need permission from the team owners.

no, he would be suing for his wife's share of the sale. Coincidentally $1 billion is half of $2 billion, hmmmm

The problem is two fold. One Alzheimer's symptoms don't include making racist statements as a symptom. Two he made similar statements back in 2002-2003, more than 10 years ago. So his recent statements are keeping with his past. If this was the first time he made such statements he maybe would have a leg to stand on, but his history pretty much negates that the disease is the reason for this behavior.

actually it does

as you lose mental control, you start saying things you normally wouldn't

Two he made similar statements back in 2002-2003, more than 10 years ago. So his recent statements are keeping with his past.

It wouldn't be hard to argue that times have changed and he wouldn't say now what he said 10 years ago . . . except his disability caused his control to slip
