Sounds like a scam to me. I bet they got it locked up in their lot. You'll probably have to call the police. Make sure you've got the title for the bike with you when you go.

So, it's still not clear to me how the bike ended up at their shop. If they didn't steal it, then someone brought it in, or they have video of who left it at night, or they need to hand over the bike.

If they have no video surveilance, then you should steal the bike back from them at night. *shrug*

I didn't think you could profit from a crime like this. It's not your fault it was stolen, they accepted stolen merchandise and must return it. How it got there is irrelevant to returning it to the rightful owner.

Get the bike now. Record the event with a smart phone. Call the police if they refuse to hand it over, do not cause a confrontation. Take a copy of the police report and your ownership paperwork/registration.

They will meet you at the shop and get you your bike for no charge.

Like someone said, the shop cannot hold your property hostage.

Actually depending on the state this may fall under State Trooper jurisdiction instead of the local police.

This. They cannot withhold your property if it was stolen. They cannot charge you for "storage" when you did not place the bike at that location. They must return the item at your request when presented with proof (i.e. paperwork on the motorcycle). Make sure you only give them a copy so they don't mess with the proof. Bring the original paperwork for the police, if the place refuses to give the bike back. Don't leave without the bike.

The police are probably going to say it is now a civil matter to be decided in court. They also suck at giving legal advice. Your state might have an attorney referral service and many of those guys will give you 5-10 min. free consult on the phone.

When you talk to the body shop guys, you can mention (bluff) that you have video of the bike being stolen, right before you demand that they cut the crap 'cause you know it was one of their guys. If they ask to see it say your attorney has it.

AFAIK contract law requires consideration and execution, none of which have taken place yet. Unless your state or municipality grants special rights to body shops/mechanics they really don't have anything.

Don't pawnshops work the same way? If they purchase stolen property, the police seize it and return it to the owners?

EDIT: Also ask them to provide proof that a letter was sent out. Some sort of certified mail receipt or something (of course they don't have shit).

Before you record the phone call make sure you are not one of the states that all parties must consent to the recording before you record them. If you have to go to court and have a recording from one of those states you will be in deep shit. It looks like you are in MA Massachusetts and that is one of the states on the list.

This 1000% "The police are probably going to say it is now a civil matter to be decided in court" I know the Pittsburgh police would tell you this they are the most worthless cops to deal with. They try and get out of anything they can.


Just go down to the shop tell them to give you your bike and if they don't call the cops and press charges for having stolen goods.

Well I went down to the shop to take a look for any damage and it was locked up. The mechanic would not let me see my bike and promptly asked me to leave his property. I have a lawyer friend who is going to help me out. We are going to grab the police report today.

I have no idea how the shop got the bike. I now know it has been on their lot since 7/16/12 and i reported the bike stolen on 7/23/12 (again didnt ride it alot and it was stowed in the back of the parking lot, so i didnt see it much) Mechanic said I thought we settled on 250$ (we did not) and I told him I'm not paying 250$ and I'd like to look at my bike. They wouldnt let me see it and kicked me off the property. This is in CT btw, sorry for any confusion my profile is causing.

So my lawyer friend is coming down to help me out

Did you read ANY of the posts in the thread???

You were at the shop... CALL 911. Have the police come out and do an incident report that you tried to get your bike back.


...How did the bike disappear? I'm curious of the circumstances, it all smells a bit fishy.. From the OP to the bike shop.

Don't understand the issue. Bike was stolen, report was filed, bike was found, go get it.

If they try to stop you, then press charges for possession of stolen equipment.

I think there's some reason that OP doesn't want the cops involved. Even if the shop flat-out stole the bike, having the cops there will be enough to get it back.... Unless the shop has a damn good reason for keeping it.

Basically, no legit bike shop would want the stigma of having a stolen bike - period. But over $250?? I could see if this were like a $5k repair or something like that.. maybe they would want to hash it out in court... But over a couple bucks?

I don't know about CT, but in NY if a stolen car or bike is found, the police take possession of it and have it brought to one of their lots.
