Its relevant because the law views "new" far differently than you do.
Its fine if you dont want to buy an opened game but arguing it isnt new is a losing proposition.
Well that's one law I don't need to follow. If I buy a sealed game and open it, then try to sell it on craigslist or eBay, I can ask $59.99 or $55 but it's highly unlikely I'll get a buyer.
