Personally I feel you owe them no more than they owe you. (True for any place.) Would they give you a month notice before they would fire you? No. So why give them anymore than that? 2 weeks if being nice IMO.

By law, no matter what happens, he cannot give you a bad ref, else he could be held for liable. (Its not exactly the law, but that's the effect.) Really companies are only looking to verify you worked at where you claim. Besides, if he's been fudging the IRS, he has a lot more to lose by trying to give a bad ref (esp if undeserved, lawsuit waiting to happen.)

well, he's an ex-friend now. I just treat him like I'd treat their boss. But I still don't want to get him into any IRS type of trouble.

I know, huge generalization, but Taiwanese people (my family and the little lady I'm marrying) are completely insane when it comes to business.

Certainly don't stay in this situation. You need to get paid, and the idea is that you be happy with your work. You've got your visa/work permit, so you can call it even or you can see if you can be compensated for not being paid; your call.

wow, now that's something I didn't think of. The whole database, the whole website, all those product pictures and graphics banners that I designed, one rm command, and they'll be all gone. :beer:

He's actually from Malaysia, but I think it applies here. He's not going to give me a bad recommendation, but it's not going to be good as what I deserve. I'm staying there now because I'm completely broke, and needed the money. Otherwise I'll be long gone.

The whole deal was that he was my college friend who started this thing and asked me if I want to join him as partners. So I did and I worked full time without pay until I have my visa situation resolved (Working permit and all). It took half a year, then he said the busines isn't doing too well, so instead of the 2.8k a month, I can only pay you 1.4k, but I have to report taxes as if I were getting 2.8k or he'll have trouble with the IRS.

I was thinking that's fine, as long as I still some say in the company. But lately I've been treated as if I were just a normal employee. You know, get yelled small mistake, not being able to make any decision.

So since I'm a computer science guy to begin with, I'm thinking of just quiting the whole sales / marketing scene and just be an engineer.

man he screwed you bad. I wouldn't call him a friend. Look he is breaking about a half dozen tax laws. Seriously you should report that guy to the IRS. Just because you once considered him a friend and he's from malaysia doesn't give him the right to break the law here. I get so pissed whenever I read about people that come to the states and start a business and break about every damn law on the books and think It is ok to do. I wouldn't give him 2 weeks either. I would find a new job and the day before i went to it let him know at the end of the day that I wouldn't be back. I would also see about suing him for the other 1.4k a month that he withheld taxes on. If he took the taxes you should get it. or at least the withholding back that he shouldn't have taken. He has done nothing that deserves any notice from you at all. In fact he has caused you at the very least a financial injury. I do not see why you would feel at all obligated to give him any notice whatsoever.

It does sound like you're getting scrood hard, with no sweet talk and no fancy dinner beforehand. He has directed you to commit federal crimes (fraud against the IRS), he has broken his (verbal?) contract with you, and he has worked you like a dog, to his profit and your loss.

I understand that there is/was friendship at stake here, but at least from the outside this looks like a relationship where he uses you up, crumples you up and throws you away. $1.4k/mo is less than I've made flipping burgers.

Run away. Start job hunting now, and when you get the job, give him two week's notice- "In two weeks, you're going to notice that I've been gone for a fortnight!"

Well said, my thoughts exactly. Companies don't give you two weeks notice when firing you, why give them any notice at all? From what it sounds like, this is a bridge you don't mind burning, so the hell with 'em.

I've decided on a month notice, that is if I found another job that needs me to start within two weeks or so. I'll do all I can to make the transition less painful for him.

That being said, I really do need to find a job first. wish me luck :beer:

But the small companies are the ones that you should avoid. They penny pinch like crazy, nevermind that they spend the extra money on themselves. Being Chinese myself, I'm disgusted at how this represents us in the states

He clearly no longer considers you as a friend or partner; you aren't obligated to give him any special treatment. This is a bridge you should leave far behind you, if not outright burn.

I gave a months notice at my last job and it was hell. during the 3rd week I was unmoitivated, I knew I was leaving and just didn't want to be there. the forth week was just hell.
