Ok i need some clafrification for a friend...he is freaking out cause he feels that he will get introulbe if his house has a party and they get introuble.

Situation.

Your house has a party
YOU are not there
Underage busted

You introuble or not?

I dont see hwo you possibly could be unless you buy the keg.

Good chance he could get in trouble. I suggest never do it again and think about the consequences if someone drove home drunk and got in an accident...

If he charges the "friend" with breaking and entering then likely won't have to deal with any trouble besides going to court. Don't know really it will depend on the police and the city how hard they want to investigate. You may be able to say you don't want to press charges because he is your friend but you will have to if the city doesnt buy your story and decides to press charges against you. I would definately keep in mind proof of your being out of town. Your "friend" if he decides to say you gave him permission to use his house while you were out of town could cause a lot of problems. Basically by saying that he would be passing the buck and then it would be your word against his. Could be a big mess or it could quietly go away with some luck.

How would they get into your house to begin with?

And IIRC (also IANAL), the homeowner could get in trouble. If the homeowner never gave consent for people to be there, they could also be charged with breaking and entering.

If this has not happened yet don't do it. Lot's of stupid stuff can happen at parties. Things get stolen or broken and no one witnesses anything. House is left in a big mess for you to clean when you get home. As you say police bust it then whole lotta problems. How many pot smokers at this party and other drugs that might come out of the closet? Run away! Go party outside with some ice fishing.

Yes, you will be in trouble. For providing the alcohol (if no one else says they did, then you are pretty much automaticly the one who supplied it) and for allowing it to happen

Yeah the rules are really stupid. Contributing to the delinquency of a minor doesn't make any sense. Why can't minors be held responsible for what they do? If they're not 18 and aren't legal to use a substance, punish them if they do. Don't punish the person who's house they happened to be at.

Not to sound like I'm ripping on your or anything, but lots of people actually go to college to get an education. If you want to get drunk and take advantage of drunk women, you can do it a lot cheaper. You don't have to pay 20k/year to get drunk and have sex.

To answer the original question, yes, you are liable for everything that happens in your house. If someone gets drunk and falls down your stairs, you could be sued. If someone passes out and has to go to the hospital, you could be liable. Basically, in your house, you are responsible regardless of whether you are there or not. So either these people had your permission, or they illegally broke into your house. In the first instance, you will get into a lot of trouble, and in the second they will. Lose lose.

Since the OP mentioned that it was a housemate, I would say you'd be in the clear, provided that the housemate is also on the lease and the lease is not just under your name. The main thing is, don't make enough noise to warrant the police coming and keep the shades shut.

What's sad, is that when I lived on my own, my roommate and I had parties and the police showed up a few times. What's sad, is that there was a series of robberies for 3 months on the same block, where a lot of houses and cars were broken into and stuff was stolen. The police were never there to try and catch them and the guys never got caught. Instead, they were only here to give out tickets for underage drinking, etc...

I am not worried about anyone showing up. The people we have at these parties are chill and in my experience as long as everyone has some kind of an intelligence no cops show up. And even if they do you dont have to let them in. Really its just my friend is having this week long party kinda thing at his house and the one housemate doesnt want to get introuble for underage drinking. Basically he is threatening to call the cops on them.(I know he is being a dick). I am trying to tell him to just go to his gf's house(which he always does_) and not worry about it.

The OP wants to throw a party in his apartment. The OP has a roommate who doesn't want the party to be held at their mutual residence.

Is that right?

If so, I think your first issue is with your roommate.

As to the second issue, if all of the above is true, I doubt he could get into any legal trouble so long as he isn't there when the cops show up. But I'm sure that varies from state to state.

Yyour lease may be in jeopardy if your landlord finds out. Depending on the lease he may have grounds for terminating the lease.

Party at my house in my absence? Nope. People really don't know how to respect other people's furniture/walls/beds etc.

If the music gets too loud and one cranky neighbor calls the police who bust a beer-and-pot-extravaganza, you don't get arrested out here but have to part with a decent chunk of cash (to tell the cops to go away). I say no - look for a different venue.
