I'm not trying to be a dick, but your wife wants her job back, right? Is the school district saying they won't take her back, or is the union just pissing a circle?

Union is just pissing. But if their pissing has merit...

Without the union I doubt your wife would have ever gotten such a generous sabbatical in the first place.

It really doesn't matter what the documents say or don't say. The union will get what it wants regardless in states that are not "right to work".

Hell, a union in Washington was able to cry to the Democrats to try and stop a factory being built in South Carolina.

I'm generally opposed to public sector unions but I don't think they are being unreasonable saying that they won't represent her if the district reneges. You can't have it both ways.

this.

I fucking hate unions, but sounds like the wife is not living up to her contract, no?

Good summation.

This. OP, not sure what you really expected. They aren't saying that she loses her position because the lack of dues. But if the school district decides to break the contract and give her a hard time, she won't get the union's help. Why would she? She's not a member anymore.

Not part of the union, you don't get union "protection". The contract is contingent on her being in the union. Sorry. It's legalized extortion, and you didn't pay up.

You don't have a breech of contract chance in hell. One of the contingencies is being active in the union. Read the contract.

Edit. You're in Ohio, you guys had a chance to fix this and voted against your own interests.

You act like she'd even have the option of a year long leave of absence without the union. I'm so sure the school administration would be all for that by their good graces when she wouldn't have any clout to negotiate her contract.

Really? If she's a union member she ought to pay the dues. Don't pay attention to the jerkoffs in here about thugs, etc etc. Not all unions vote democrat or donate specifically to them.

No dues equals no union protections or benefits. Small price to pay for peace of mind.

May as well consult a lawyer ahead of time, but that would probably cost just as much as a year's worth of dues.

Unfortunately a lot of the anti-union sentiment is accurate. My union is so damn crooked, both local and international. Had to have an election redone here in our local, and the international convention was an exercise in dictatorship and election rigging.

And I'm all for getting rid of unions. As long we also eliminate corporations. If workers can't utilize their capital (labor) in groups, then neither can investors. Every worker for themself, every business owner for themself. Fair and square, right?

You sound like a used car salesmen, only slimier.

With the pay, benefits, and work schedule that my union reps negotiated, i'm more than happy to pony up a few dollars a month. My health plan is 17K a year; free thanks to our negotiated contract. I only work 180 days a year; thanks to a negotiated contract; generous salary, vacation days, personal days...etc etc. thanks to my union.

I know its hard to be on the outside looking in...but it's pretty fucking good being on the inside.

Unfortunately, this is true. Not to mention, you'll be out the same amount of money, and the union will cold-shoulder her from now on because they don't like people that don't do what they say.

All the unions I've ever encountered were slimey, no good piles of shit more interested in greasing the palms of the union leaders than looking out for the welfare of those it represents. The absolute worst part is that the people coerced into the unions are the very people who can't really afford to lose $500/year to union dues.

And I'm all for getting rid of unions. As long we also eliminate corporations. If workers can't utilize their capital (labor) in groups, then neither can investors. Every worker for themself, every business owner for themself. Fair and square, right?

Unions were good when they were needed... 40 years ago. In 99.9% of cases nowadays, that need is no longer there.

Look, the school board understands the power of the union. If they find out that she's in limbo with the union, then it'll be like drawing sharks in the ocean with a drop of blood. You can't have it both ways. Either you're in, or you're not. You should pay the union dues, and fall in line with their protection. Otherwise, you're on your own.

I'm part of a teacher's union, and I hate unions. But in Michigan you have no choice. When employed with an organization with a union, you have to pay the dues, regardless of whether you 'opt' in and become a member. So why not just join? My opinion is "Keep your friends close, keep your enemies closer". BTW, I am no democrat.

You can't have it both ways..

Yea, my ex-wife didn't opt to join the teachers union at her first job. The administration dumped so much shit on her that the first thing she did at her second job was join the union.

I lol at people that try to claim unions aren't needed anymore. Yea, all corporations are kinder and gentlier now. They're just out to take care of the little people and make a little on the side.

You may find that the union tells the school board that she is no longer a member in good standing, and that the agreement regarding the sabbatical is no longer valid.

The question that needs answered is the contract contingent on union membership? I think no but was hoping for others input as we're sure not going to get straight answer from the union.

What does the contract say in that regard?

I am a lawyer and have handled various employment matters. I come to the discussion with reason and facts:

There was a time for unions and because of them, we have a great deal of employee protection laws. However, the time for unions as a presence in the workplace has passed. Unions should be converted from employer-specific organizations to state and national lobbies to help maintain the current laws and to proposed and support new ones.
