Updated: Suite Tenants Smoking Marijuana

Let's start off by being clear ... I don't give a shit if you smoke or not, nor do I care what you smoke. However, if you're doing it on my property, there is going to be trouble.

We have a strict no-smoking policy, and also asked (and the tenants agreed) that there would be limited smoking (tobacco) on our property.

Tonight, I take the dog out for a walk, and when I'm about 50 yards from home I could smell the joint quite clearly. As I walked to my front door (tenants have their own side door) I could smell it even clearer. Just to be 100% sure, I went upstairs, and opened my ensuite bathroom's window right above their door, and could see them, and got another faceful of smoke.

I am in the midst of prepping a document telling them this is their one warning ... any further illegal activity on my property will result in the police being called, and them being evicted.

Anyone have any experience dealing with this sort of bullshit?

Update:
Talked to them, told them it wasn't acceptable on our property, or anywhere it would affect us, our neighbors or my property. He started to deny it, but then backtracked, apologized, and said yeah, normally they walk over to the park. I said, yeah, that's fine, just don't do it here. No letter, no formal complaint, no cops ... just a somewhat stern warning, and a second chance.

Yeah, it is illegal. As I mentioned, I just don't care that much personally, but since it is on my property, and there could be legal ramifications.

The tenants are, we realize now, both smokers, and they obviously both enjoy the MJ from time to time. I have seen and smelled them smoking up in the local field prior to this occasion too. What a pain in the ass.

I don't really want to call the police at this time ... but after this warning I give to them, I will be doing so for the next occurrence.

Where are they supposed to smoke it?


The situation is a bit unclear... is it your house and they are renting a room? Is it your apartment building and they are renting an apartment?

Either way, if you supposedly do not care if they smoke marijuana, then you shouldn't care even if it's "your property"... because you know what...if you are leasing the use of that property, then really it's not yours, it's theirs for the rental duration... you cannot just go into the place uninvited because "it's yours".


It''s not about "your property" becuase if you cared about what happens on it that much you wouldn't sell it's use to strangers.


If they are paid up and not destroying the property or altering to a state that will carry over past their lease time, it is of no concern to you.

So in realty, either you have a problem with marijuana smoking or you are just a dick.


Either way, you should just talk to them instead of pussy noting it.

Wow ... deftron, you've got some issues to deal with. Yeah, I have issues with marijuana smoking on my property, they were smoking outside, it is illegal, and it could be smelled inside my house, and elsewhere on the property.

For the record, it is a suite in my house that is rented, 800 sq foot, including a full kitchen.

EDIT: to answer where are they supposed to smoke it? Nowhere, it is illegal, so they are not 'supposed' to smoke it anywhere.

That's how I see it. It's no liability to you if they're smoking weed. If they're otherwise good tenants, ignore them. You might get rid of them, and get tenants that make you long for the good old days when all you had to worry about was some weed smoke ;^)

It's not about it being illegal... I'ts just that you dont like marijuana...If they were illegally downloading a song off the internet, would you be so concerned to "write a note, then call the cops" ?


Talk to them about it. Dont' be a dick tho. I'm sure they will respect your concerns.

Haha, you see ... it is about it being illegal. I don't like illegal activities on my property, where I am liable for things. And comparing it downloading a song is pretty comical ... thanks for the laugh.

I do plan on talking to them about it though, I just want to ensure that I have my ducks in a row so that if it happens again (i.e. they don't respect my concerns), that I can take action.

I just checked where Sidney is, and found it's in the Victoria area. I've been thinking lately about what I'm going to do after school and I think I'd like to move somewhere with a milder climate, and specifically year-round golf. Victoria stood out as a nice area. It apparently gets much less rain than the rest of the province.

Is the entire district of Saanich part of the city, or just the lower part?

Is is essentially a part of Greater Victoria. They are separate municipalities, but all act as the same larger city. I'll tell you, I moved from Northern Alberta this past summer, and year round golf was one of my ideas too ... and I LOVE it here. PM me with any further questions that I could answer for you.

You are incorrect. Simple possession of marijuana has been decriminalized in BC since 2003.

What liability?

Cops won't be able to smell it over the high background level of dopesmoke in vic anyways.

what kind of liability would you be in for your tenants actions?

idk how the law works in Canada, but if I were caught doing something illegal inside my apartment, I can't think of any possible way how that could blow back and get my landlord in trouble.

You are incorrect. Simple possession of marijuana has been decriminalized in BC since 2003.

Yea no shit, ever been to the coffee bars on east hastings in Vancouver? Doesnt seem very "illegal" like the op states when you can smoke in the new amsterdam cafe while police officers pass by you. If you are annoyed by the smell of the smoke, tell them to smoke outside in a different area. Stop being an asshole.
