Weird AMD 2500 Overheat Question...

A customer of mine has been having issues with an over heating AMD Barton 2500. I checked it out and the CPU gets to like 75 degrees cel. and then it powers off... All the fans are working properly, I know it is the cpu, because i installed a different one into his Biostar Barebone and it works fine... So any suggestions? Is it possible to fix... or more so...does anyone know why the chip might be over heating? I purchased it OEM from Newegg in January...so are there any options as far as getting my money back from AMD?

Any info might help, I am going to test it out in another system right now and see what happens...Thanks all...

positive his heatsink is in contact with his chip on his board?

Yes absoultley positive...in fact... I pulled it and put it on to another mobo..left it running with Prime95 for about an hour last night...watching the temp. I slowly creeped up to about 55 deg cel. then out of no where it shot down to the high 20's...never really went higher after that...and this was after 45 mins...

Confused I am...

What is the voltage set at? What kind of heatsink is it?

It is a biostar 210V, and I am using the stock all copper heatsink, with Artic Silver for paste. Voltage is set to 1.65... This has certainly got me stumped, i wonder if it is a flawed chip?
