Hi,

I have been using Windows 7 Home Premium 64 bit for two years now and I have my old boxed version of Windows XP Pro with manuals (upgrade version, bought at a store like office max or so, I don't remember), my question is that if can I sell it or if it is tied to my past computer configuration and can't be sold?

Any help appreciated.

You'd have to read the license. I /think/ it's transferable, but without reading the license I don't know for sure. I do know it'll work. I bought my last copy of XP upgrade used, but whether it technically violates any license or not...

If you bought it retail, you should be able to resell it, but the ethical thing to do would be to tell the person who may buy it, that they may need to call Microsoft's activation hotline to make it work.

Only oem versions are tied to a specific computer.

The question I have is what if you upgrade an upgrade? Say you had a full path of upgrades from 98-XP-Vista. Could XP be tied to Vista since the upgrade was made from that system? Get rid of XP, and your Vista could be construed as invalid. I don't know that it is, but that's not an unreasonable way of looking at it imo.

No, the upgrade can be sold as long as it's not oem. There is no such thing as being tied to another version of the OS.

It appears you're correct. Wikipedia gives this...

Retail licenses, those purchased from a retail store in complete packaging, are of two sub-types: "Upgrade" and "Full Purchase Product", often abbreviated by Microsoft as FPP. FPP licenses are transferable from one computer to another, provided the previous installation is removed from the old computer. Although upgrade licenses are also transferable, a user must have a previous version of Windows even on the new computer to which they are moving the installation. Retail licenses include installation support for end-users, provided directly by Microsoft.

The XP EULA gives this...

UPGRADES. To use a Product identified as an upgrade, you must first be licensed for the product identified by
Microsoft as eligible for the upgrade. After upgrading, you may no longer use the product that formed the basis
for your upgrade eligibility.
And...

Transfer to Third Party. The initial
user of the Product may make a one-time transfer of the Product to another end user. The transfer has to include
all component parts, media, printed materials, this EULA, and if applicable, the Certificate of Authenticity. The
transfer may not be an indirect transfer, such as a consignment. Prior to the transfer, the end user receiving the
transferred Product must agree to all the EULA terms. No Rental. You may not rent, lease, lend or provide
commercial hosting services to third parties with the Product.

The two terms from the EULA are somewhat contradictory. It's strange to me that you can't use it, but can sell it :^/
