From a fellow Badger, glad to see your brother got off.

One question though. I know Wisconsin doesn't have a concealed carry law, so how was your brother not charged with carrying a concealed weapon?

No offense taken. I share your concerns, in fact, my first question when I heard about the incident was "Who the f**k sells a gun to guy that looks like Charles Manson but wearing a kilt and chain mail?" Turns out it was totally legit, in Wisconsin anyway anyone can buy a gun unless they have a felony record or have been involuntarily committed. Neither of those applied to my brother (and still don't). Even if they don't give my brother's gun back, he can still get a new one legally. No criminal convictions on him whatsoever, yet.

Thanks for all of the kind words guys. Most of the initial press following the incident were along the lines of "Crazy homeless person kills son of former legislator." I have a warm fuzzy feeling now because there are no flames in this thread after >30 posts. :heart:

I agree that in this your brother was not guilty, but at the same time wonder about his ability to carry a firearm.

While a gun can save anyone's life, in the wrong hands it can end many.

Taking the law into one's hands is not about self-defense. It's only about when you could have walked away, called the police, not chase someone down.

Best way to end any altercation is to walk away. Many think since they are packing; they should get some groveling apology from a 'possible' assailant. Then things go south and they get attacked and the now pissed off assailant gets killed.

Two wrongs don't make a right.

It was not self-defense, she said, when he shot Bodahl with the gun he carried in a homemade holster under his kilt."

Quite a story, glad it worked out for your brother as it should have. It's really something that you don't hold the guy in contempt for putting you all through this. I'd be pretty pissed at the time lost in my life to the ordeal and glad that a jerk like that can't go on to breed.

I read about this in the local news. As a recent transplant to Madison I was interested to see how a liberal town would react to a self-defense shooting. Looks like the people on the jury reacted like I would have.

"'The defendant wants you to put a stamp of approval on his decision that 23-year-old Austin Bodahl deserved a death sentence for simply being drunk and disorderly,' Mades said." Since when is trying to beat the shit out of someone merely drunk & disorderly? It's aggravated assault.

And f the 'witnesses' who said neither man looked like they were winning the fight. They're a bunch of cowards for not doing something.

I hope to see your kilt-wearing bro on State St. again.

They probably would have if i had answered any of their questions. i used my rights at the interrogation table. that's why they went for the nuts. "Oh this guy thinks He Knows His Rights, huh?" "You just read them to me dickhead."

the lawyer said something about that. it was a long time ago but i think it had to do with having to prosecute the most severe crime first. after i was found not guilty on that charge they can't really charge me with carrying a concealed weapon cuz that would be an attempt to circumvent my right to self defense. had they tried it would have gone to the state supreme court and wisconsin would had become an unregulated concealed carry state. i proved my use of lethal force in self defense. they cannot then say i had no right having possesion of lethal force, not without losing another case anyway

or something like that.

sand castles, i used to make them every day in elementary school. and at the end of every recess i'd smash them. for six months i built a sandcastle made of pure hate. it's proving a little more difficult to smash

walk away, hell. i ran! gave that fool so many chances. the only reason the cops never found the bullet marks was because they didn't look far enough away. after successfully thwarting his attack i had to make a get away since i popped off 2 shots in the heart of downtown with an illegally concealed weapon, i went for my bike and stuff. this is when the other two began.... thinking. they figured they'd block me from coming back and getting my bike/junk, make me run for it before someone comes about the gunshots, and make off with it like bandits themselves. Now the assault is a mugging. no way i could have made it out of there without my bike. they managed to stall me long enough for bodahl to get back up, nearly get squished by a bus, come back and jump me again.

did you know i won my trial without ever even testifying?
